good offer :) take it !
  • Dear RedX

Thanks for all your detailed replies and I am so sorry.

Ok , I will explain a few things, because although understand your frustration i feel that some of the comments are truly unfair. I refer to the post number by te symbol #

    1. I posted my thread on 1/11/15.

#6 page 2 of SCS letter in hxxp form ( I didn't have privileges to post lnks) #10 that was uploaded

#9 page 1 of SCS letter in hxxp form- no response; wasn't uploaded

#15 reposted page 1 in hxxp form again , but no response again

#18- first sarcastic comment " popcorn time"

#19- asked again of someone could please upload page 1 of the SCS letter#

#20- CM kindly advised to wait for beavis outcome- I did

#25- CM kindly advised again to wait for beavis before replying to SCS l

#28 letter form PCC uploaded as hxxp- kindly done by DACK

    posts 1 to 28 all on 1/11/15, so I wasn't idle

#32 Iamemanresu- asked me to contact solicitor- I replied (#34) =etc CAB

    #37 HO advised robust reply

#38-39 discussion of costs etc.. appreciated, useful but maybe not relevant at that point in time

#40 Iamemanresu- " headless chicken lots noise no action" in reference to me

    #44 asked about permit/lease,,,etc I replied #46

#51 Patman kindly advised get lease etc..

#58 I asked general q if SCS were real or not, reason being because I wantd to prepare a reply if they were real

#61 Iamemaresu askes again about if I seen a solicitor etc.. and comments " am in denial, siting at screen"

#62- replied to #61- I haven't been idle; awaiting lease from LR/DVLA to check NTK/and waiting for reply from management co re contract wit PCC; also explained my calls to various solicitors etc..

#63- Iamemanresu- asks about rental agreement; also mentions its odd that no solicitor is interested etc.

#64- reply to #63- quoted relevant parts of rental agreement

#66- bargepole- kindly explained difficulty in fining solicitors with interests in PCC. advised try Harcus soliciors

#70 reply to #66- I had called Harcus etc.. and had also spoken with RAC

#74- zoonyx raised very relevant point about parking outside space

#75- I felt I need a reminder of the current dilemmas and asked more Qs

#79- 9/11/15- CM advised robust reply. I posted it on 10/11/15

#82 - #91-useful discussions about CCJs and crdit ratings etc. very useful info that I didn't know

#92 asked categorically whether the SCS letter referred to in #6 and #9 was an a true LBA or not- intersitngly, page one of that letter still handt been uploaded despite it being available in hxxp

#104 CM a very useful and FIRM YES, treat as an LBA- I was looking for a definte answer and CM replied. Thanks CM

#103-110 few exchanges wit Iamemanresu regarding pis/street views..I explained clearly why I was rather apprehensive. I even offered to PM the streetview but not to post it on general because I felt it was really going to identify me; I had genuine concerns just posting my postcode; its not a retail park; its my private residential address-

#113-#115- I posted that I have had a reply to my letter- a detailed one from PCC via the SCS

#116-118 asked about pics signage- i explained again why I just cant post all the pics on general because of concerns- again offered to PM them. mentioned I had sent PMs to Iamemanresu but no replies- this showed my willingness to really seek advice but I hope you realise my resevation

#118- decide to get close up view of signages- I did ask about jpeg/ uploading. I already knew about tinypic, but because these were pictures taken by my iphone, rather then actual pictures physically in my hand, I couldn’t just cover parts with a piece of cardboard and then post on tinypic; I wanted to know how to electronically edit the photo..etc. eventually worked out ok

    #120-121 advised how to

    123-126 signages posted

#127- nigelbb commented about it; did gain on 131 because I had a question for him; his reolies were extremely useful

    #128 asked advice about deadline in responding to latest correspondence;

129- still wanting advice about the deadline and also that I wanted to upload the letters but rater than taking a photo like I had done initially, I wondered about pdf etc... I got the reply from redX

#134 CM asked q- as usual very clear Q and I replied immediately

~136- now explained current status and the immediate problem at hand- eg recent received correspondence etc..

I feel that whenever I have been asked a Q, I have genuinely tried my best to answer. It may not have been the reply expected. For example, when asked about solicitors advice/ posting google address, I clearly did not ignore anyone; I gave an explanation not an excuse. why should I give excuses when I’m asking for the advice from the forum?

I can appreciate many here have had 100s/1000s of posts and been here members for years. I only posted on 1/11/2015, and because of the time restraints, Ive been too preoccupied trying to reply and seek advice and read around the topic, and hence not spent much time investigating about how to upload pics/douments. Believe me, I’m not at all into uploading things on the net or hosts- didn't even know they exist, so all is new to me. I don't even have a facebook account etc.. not really into social media/ instagrams etc.. just heard about them from my teenage daughter

I have labelled my case as complicated. Perhaps. its because when I posted it it sounded all new and complicated. However, I feel it is very defendable, and I am not asking really for legal advice, rather Im asking for general advice, but am aware there are kind volunteers who may even be solicitors . I’m not asking them to take on my case. Im not asking anyone to write my letter. I’m happy drafting everything etc.. but sometimes, it would be nice to be able to may make reference to past cases in court eg beavis PE; PE v Somerfield etc..What im asking for is for kind volunteers to look at the letters, and see whether they may have good replies to the points raised. For example, nigelbb referred to the signage and that it sates unauthorised on it. well, Nigel may not be a solicitor, but he probably has gained so much experience from various for a/cases and so he gave me that advice.

That's what im looking for. I share my letters/case. kind volunteers advise and reply to my queries. I will write te reply. I will go to court. im not asking any kind member volunteer to do it for me

Before I conclude, I will give brief summary and let you judge whether it is truly a complicated case or not

I am a tennat, renting frol a landlord, in a block of flats managed by a management agency, who policed the parking to a PCC. I have been parking in a space without bay marking. Its on a private land and is part of the estate. It belongs to the freeholder

    1. Received SCS letter regarding 6 charges for parking outside other than within the marking of a bay ..etc.

    2. Received another SCS letter re the same matter for my old car. total of ~15. Not replied to this letter

    3. replied to 1. I belive robustly

    4. got a reply to 3 from SCS dated 19/11/15 in which there is a detailed letter from PCC dated 11/11/15. PCC answers my points from letter in 3 point by point and alloews me 14 days to pay or they will issue court proceedings

Now, im asking two Qs which I raised in #113-115; which date do I take the 14 days to be from, 11/11/15 or 19/11/15. The other Q is if I did post the letters up correctly as redX suggested, it may be very revealing about my identity, but am willing to do so. risking them identifying me, if Im going to get good advice. The points raised in the letter are not novel and that's why I think those with expertise, even though not solicitors, may be able to give me tips

Im sorry for the lengthy reply, bit I felt I had to clear the air

If you think Im being unreasonable, dripfeeding, idle, etc, then I will respect that and just stop, and hope that I can single handily defend this. This thought worsens my despair, expressed in the title of my thread

If you feel after this explanation that you are willing to give me the chance to get the relevant advice to fight this case, then I will be very delighted

I want to press on with the case and be in time with the replies etc.. so if you are in agreement that I should continue here, then lets please focus on the contents of the letters. I don't feel any comments that are not immediately relevant are going to help me; It will just make that feeling of sinking in my chest worst everytime I check for a reply. No point in being told off. I accept I did follow old advice about ignoring stuff ( not from here), but I really genuinely dont feel i owe any debt for parking where i live

Thanks for your consideration in reading this

    Dear RedX

    thanks for this last comment

I was busy typing the last reply and by the time I pressed submit I saw your comment

    have a nice evening :)
  • I have only skim read this long long thread this afternoon

However I note on page one the second page of the SCS letter is asking for payment to be made directly to DRP. I cannot find your first page.

Therefore this is not typical of the standard LBCCC issued and is rather like the Wright Hassall / ZZPS cases we see.

UKPC also tried their attempts with JMW solicitors at one point as a debt collector stage.

This reply you now have - who is it asking for payment to be made?

From my experience SCS letters typically go nowhere - although I have enjoyed a few battles with them in the past.

The management agent is on a kickback for every ticket paid by UKPC - standard going rate is 10% of the value of the parking charge.

I have also seen many leases where there is no chance of the PPC or the management agent overriding the lease rights applicable.

That is not to say that UKPC have tried court cases with multiple tickets issued which have also included tickets at own property - however they were given a beating on at least one occasion.

I would be quite happy to take your case out of the glare of the forum and you can email copies of the letters via the BMPA - which will guarantee your private details will remain just that.

Please note that this is Not touting for business - although you can contact me directly that way if you wish.

    Dear 4consumerrights
many many thanks for being so kind

Rightly so, the first page of the SCS letter hasn't been uploaded.

I posted it as hxxp on post #9, but for some reason it wasn't uploaded.

anyhow, I will post them in sequence in sequence in the following posts.

I would be grateful for a kind member to change the hxxp to http sign

Do it yourself - you've got more than enough posts on this one thread alone to have uploading privileges.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Do you honestly think that if UKPC has been reading this thread they won't have already identified you?

I agree, but Ii hope you can appreciate why I have been so reluctant.

I just felt i wasn't getting anywhere and as some pointed out, going round in circles.

The posts preceding kept on asking for more info, and i have been anxious, but Im not sure how else I could get this info

are you suggesting I delete them from the thread?

    Thanks

I would suggest you do as 4consumerrights said, instead

there is far too much to this saga and it needs somebody off the forum to wade through the mire , which could take them hours
