As I already explained their charge cannot be for breach of contract. The sign clearly states 'NO UNAUTHORISED PARKING' so that is clearly not an offer of parking. You cannot enter into a contract to do something that is not permitted e.g. park without a valid permit.

thanks and apologies for not fully understanding what you typed earlier. You have made it clear to me now.

    thankyou again

Do you have any court cases, please . I want to use this argument if I am summoned to court, so it would be nice to know of a case.

    Regards

You dont get a summons. It's not a criminal court even if they try - UKPC rarely do but occasionally when it's a number of charges at stake. But this is NOTHING like the Beavis case.

A assume the original PCNs were all £100 each? Or £90 each?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Dear CM

I sent a letter dated 08/11/2015 in reply to the LBC from the SCS. Posted it on the 10/11/15.

got a reply on 20/11/15 from SCS. The SCS letter had a covering letter dated 19/11/2015. in addition, SCS had enclosed a detailed reply from their client, the PCC, dated 11/11/2015. PCC, in their concluding paragraph have given me 14 days to pay or they will issue court proceedings. Im a bit perplexed because I never got their letter dated 11/11/2015 directly, but only received it in the envelope sent by SCS.

So, does the 14 days start from 11/11/15 or from 19/11/2015. If the former, then its a very sneaky way, because I only received the letter ( as part of the SCS envelope) on the 20/11/2015. tis gives me hardly any time to reply.

I really now need the expert help from here because the letter is very legally orientated and despite reading around he topic, anyone with legal expertise would be very helpful, and of course appreciated.

    Thx

Stop getting your knickers in a twist, who does the SCS letter say reply to?
The more you contact these scum the more they will try to bully you in to paying. I am down to one every six months now including SCS, they will give up soon.

    Thanks

    you cant

let me put this in extremely simple terms

you cannot upload ANY FILES to this site, none , nada , zilch

the sooner you stop asking that the better, which is why I replied about hosting files on sites like tinypic and photobucket, because we all have our own "fields of expertise" that we can assist with

in fact you were told how to host files on tinypic at the beginning of November and yet you asked again yesterday (3 weeks later), before my latest reply !

if you wish to host a pdf or word doc or some other media file on the internet, you find a suitable webhost and host it on the web !

so for files like a pdf you would use a hosting site, sites like the old rapidshare , hugefiles , zippyshare , uploaded.to , or something like dropbox

please stop assuming that MSE will host your files, it wont as it costs money due to bandwidth and storage, never mind slowing the site down if people started hosting their files here

I hope that clarifies these hosting files issues

you should also remember that this is just a small civil case over a parking invoice, you seem to be treating it like a criminal case involving Operation Yewtree , its not !

there is nothing to be "worried" about , if it goes to court its a small claim like you see on Judge Rinder, without the dramatics as it wont be on tv. your "worst case scenario" is that you will owe some money to UKPC due to the judgment falling in favour of the claimant, to be paid within 28 days

you will get advice from other members here, that is why the forum exists, to exchange information and advice, you wont get somebody taking your case on for you, especially not for free , people here are volunteers giving up their free time to advise others, you have had plenty of that time and advice thus far, mainly to try to help you understand this legal minefield

    thanks for reading

Im sorry if I sound thick, but please let me know if this is possible

    thanking you

long and laborious job if you did that, not really helping you or anyone here either

my point is this thread has several pages and some stuff you ask about has already been explained, like the upload situation, especially with pictures

I already explained what you can do with the pdf, once done people can download it (like they do from parking pranksters website with his court transcripts which are also in pdf format)

once people who wish to look at this pdf have downloaded it, they can open it in adobe reader, same as we have done for over a decade

so like I said, people who know about a topic can advise you, to a degree, but this topic of yours is complex and really needs a legal mind on it, which you wont get for free unless a solicitor does it "pro bono"

so at the moment you are asking for things far in excess of what this forum is for , that was my point , you have a legal matter and need a legal mind to help you , you know this already, yet you expect some knight in shining armour to step in and take it on board, this wont happen, I can assure you that nobody is going to give up their free time for this

yes people will give advice, whatever the topic might be, but your opening statement said it was complicated, guess what ? it is complicated

I spent some time reading through this thread and realised we are all going round in circles , plus you are trying to cram a lot of knowledge into little time

webhosting is a pc and internet issue, not parking

a legal case like yours is not about parking, its gone far beyond parking and is in the legal realms of a possible small claim in the small claims court, for unpaid invoices , the fact it relates to parking and not to a decorator invoicing you on a "per room" basis is the only reason you have posted in this forum and not a DIY forum

you have a complex legal case about unpaid invoices over parking charges , several of them , over a year or two - we get that

    what we dont get is

    1) why you ignore or forget previously given advice on the earlier pages

    2) why you dont seek the professional help you keep asking for

    3) why you dont do a crash course on computers and the internet so you understand hosting files on sites and what tools are need for you to do the job so others can see the files

its like you are trying to learn 10 topics at once, sorry to say

you were advised to try Harcus and the RAC foundation, people like them are the ones who understand these complex issues, they will help you, but yes it may cost a lot of money. the vast majority of people on here reading this have no legal training, its not even a legal forum, its a general debating forum that volunteers try to help with advice on general parking matters , but few if any solicitors, lawyers and the like come on here, even less (if any) do pro bono work (although some members sometimes act as a lay rep for legal matters)

ps:- you havent upset me, I just feel exasperated at some of the "help" you are asking for , especially when some of the answers were given weeks ago , like the tinypic issue that I replied with and then found you already knew this on page 1 (I read the whole thread this morning, half of the stuff is now on repeat like deja vu)

you seem to skim read replies and dont take on board the content, leading to repeat questions and repeat replies

tinypic and photobucket are for pictures, I have no idea if they support pdf or word docs , why not go there and find out instead of asking us ?

I already gave you more examples of upload sites, why have you ignored what I typed ? (I notice you have done this with other members like Iamemanresu and nigelbb too)

I have only skim read this long long thread this afternoon

However I note on page one the second page of the SCS letter is asking for payment to be made directly to DRP. I cannot find your first page.

Therefore this is not typical of the standard LBCCC issued and is rather like the Wright Hassall / ZZPS cases we see.

UKPC also tried their attempts with JMW solicitors at one point as a debt collector stage.

This reply you now have - who is it asking for payment to be made?

From my experience SCS letters typically go nowhere - although I have enjoyed a few battles with them in the past.

The management agent is on a kickback for every ticket paid by UKPC - standard going rate is 10% of the value of the parking charge.

I have also seen many leases where there is no chance of the PPC or the management agent overriding the lease rights applicable.

That is not to say that UKPC have tried court cases with multiple tickets issued which have also included tickets at own property - however they were given a beating on at least one occasion.

I would be quite happy to take your case out of the glare of the forum and you can email copies of the letters via the BMPA - which will guarantee your private details will remain just that.

Please note that this is Not touting for business - although you can contact me directly that way if you wish.
