    Speeding in built up traffic / pedestrian areas is treated as an aggravating feature by the sentencing court, so speeding on an empty motorway at night would be relevant in the sense that it wouldn't be treated as an aggravating feature, whereas speeding through town would.

    What the guidelines actually say are high level of traffic or pedestrians and location such as near to a school. Yet you have chosen speeding through an empty town at night an aggravating factor.

    I obviously wasn't clear enough; I meant speeding through town when it is built up with traffic and/or pedestrians.

    It's hardly relevant and even without traffic or pedestrians a town would still be a built up area.
