I am rather curious to question the legality of the workings of these car park cowboys.A recent supreme Court found in favour of these cow boys. However my question is, where are these cowboys getting your car registrations from?Is it DVLA? Where ever it is they have to be in breach of the data protection act.Thiis kind of info is privileged and as such is only available to the proper authorities in the police, customs etc. These cow boys don't have the right to these details and I personally feel that an investigation is in order.
oh dear here we go again
to put this in a nutshell that covers present time:
when the POFA was passed by the government in 2012 it gave the ability of Private parking Co,s to get info from the DVLA , with a lot of proviso's
the main one is that they are a member of an approved ATA , oh look , there are 2 now!
IPC and BPA , any company that is not a member or has been kicked out (ANPR ltd) or suspended (UKPC) cannot legally get info from the dvla0 -

Should my case be seen in court, would the part above work in favour for me in any way? They are obviously suspended based on their actions so how can they be taken seriously in a court of law...0 -
UKPC is not UKCPS.Je suis Charlie.0

They may also be fiddling v.a.t. If, as they claim, this is contractual charge, it is a fee for parking, and thus vatable. Have they accounted for vat on their paper work?
Ask them for a vat invoice. If they ignore your request, (which they probably will), it is a useful stick with which to beat them if it ever gets to court. More reading here

You never know how far you can go until you go too far.0 -
Update:
Just called the court and they have discontinued the case.
UKCPS pulled out!0 -
Well done.
I think that's quite normal for them when the defendant submits a reasonable defence.0 -
I like this!
Something to consider if everything goes in my favour
Cannot see any reason why you would fail
The PPC .. UKCPS, were kicked out of the car park before you got your ticket. That is a fraudulent act trying to extort money from you with no permission from the landlord
A positive case for the DVLA to investigate

And yes, in the meantime do contact the local papers to expose this scammer and it will make good reading for the Gym if the public see that UKCPS were kicked out
Don't miss the opportunity, it's perfect to expose UKCPS0 -

That's great, are you going to let it rest or do you want them exposed ? After all, they did harass you to extort money in a fraudulent manner.
The more bad exposure these scammers get is in the interests of the general public
And, you should let the DVLA know what UKCPS are up to0 -
I definitely would like them exposed but having wasted a lot of personal time drawing up my defense, taking pictures of the site, posting letters etc i don't have the motivation to pursue further right now - especially since i wont be receiving my costs back as it never went to hearing.
I do intend on contacting the DVLA, as a means of protecting other people going forward.0
