    Indeed it does state that an additional 14 days on top of the original 14, from the date of service.

    I will have this dealt with within this time-period, fingers crossed.

    Please get this in writing, if you havent already - it will make things substantially easier to deal with if, or at court.
    And to show that you are being reasonable, write to the PPc telling them that they have no case.

    Next Draw up a list/time sheet ( if you haven't already) with all your costs including time spent - i believe you can charge up to £19/hour or part thereof
    so for example:
    initial Researching from (date/time start to time end ) 1 hour £19
    site visit:
    12 mile round trip (@25p/mile ) £3.0
    Two hours 19x 2 £38
    Council parking pay and display charge £1.80
    and that would be just over £60 for starters

    There is a limit on how much expenses you can claim, however if they have been unreasonable then the limit is significantly higher.
    From the Plain Language Commission:

    Hi,

    I didn't at all realise that i could counter-claim for the inconvenience.

    Realistically, the gym is only 1.5 miles away from my home location and with no council car parks nearby.

    I can however claim on the time i have spent researching and calling total fitness to have this resolved!

    Thanks for this notion - it will be a rather gratifying experience to rebound their claim.

    It's not a counter-claim, it's just your costs. Simply keep track of it all and be ready to request a costs order from the court when you win or they back down.

    As above its not a counter claim, just your costs and nothing else.
    for your time spent/wasted and any other such items. So that you are in the same position financially as you were before the Parasitic parking company started this whole mess, even if your costs dont appear to be a huge amount you should claim them, be honest, be truthful you are not aiming to make any money its jut a re-set.

    If the PPc was still under the auspices of the Gym then you could claim costs against the gym, however as they had dismissed the PPc at the time of the parking incident you can only claim against the PPC..
    It may be worthwhille talking to the Gym manager about how having a PPC on his/her site puts them at risk, as they are liable for the actions of their agents

    Understood.... If only mental health had a price!

    I believe from previous discussions with the gym manager that he is fully aware of the disadvantages of contracting with PPC's; they was only active on the car park for 1 year before the contract was severed.

    What i find the most exciting here is that the PPC have inadvertently set themselves up for failure by enforcing without authorisation.

    I wouldn't wait, K - be proactive, with gym mgr onside...'after all, it's unlawful/ludicrous/ridiculous/unfair[other words are available] that you risk losing business, getting a bad name.. when, in fact, you saw them off over a year ago! Why are they not being pursued?'' ;-)

    You do not queer your own pitch in so doing ahead of any Court prroceedings, in case that is a fear.

    Pease amend the title of your first post and subsequent posts where you have used he words fine and penalty. You have received neither, but have instead got a speculative invoice. I'm surprised he regulars haven't mentioned it already.


    As far as your costs incurred, include cost and time of 'phone calls, stamps/envelopes etcetera, in fact anything that has caused you to spend your time or money no matter how small the cost on top of the other suggestions already mentioned.
