For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -

I see that no-one yet has raised the v.a.t. issue. Has anyone yet raised this? If not this is worth a read

I also see that no-one has wondered why UKCPS are still dishing out parking charges months after their contract had expired? How much money have they illegally fleeced off people in this way? Maybe a FOI to the DVLA is required, asking how many times they have asked for keeper details on that car park since the contract ended (this won't account for windscreen tickets paid, if such were issued). How many people have paid up? This needs exposing to the public!0

@OP
A brand new thread has just emerged which you might want to keep an eye on - it has the same protagonists - Total Fitness and UKCPS. Very similar scenario and with court papers just served, like yours. Whether it's the same location as yours, I'm not sure.
You might want to check things out with the OP there via PM. I've also cross referenced that thread with yours.
https://forums.moneysavingexpert.com/discussion/comment/69446425#Comment_69446425Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You should both (you and the other poster) report this together to the Police and 'Action Fraud' as well as (of course) acknowledging and defending the claim so it doesn't win by default.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This also needs to be taken up with Total Fitness head office. If the two cases we have seen here are at different gyms, then there is a systemic problem, and HO will not want to see adverse publicity on this [STRIKE]when[/STRIKE] should someone tell the national press what's going on.0

Quick update - I have informed the gyms head office of this issue, strangely they are only available via email.
I have been in contact with the other forum member who received a court letter regarding a charge received on the same gym; Umkomaas thank you for connecting these two threads!
ampersand - don't worry about the hijack and if I am truthful I hadn't a clue what was being said between you both! Maybe my forum lingo has a long way to go
I am still waiting on a signed letter from the gym, however i do have email proof from the manager that they wasn't contracted at all in 2015.
Once i have this letter, it will be going in my court defense and also to the local media; the head office have been made aware of this.0 -
i have also informed head office about my predicament, stating the affects this company is having on its customers at my local Total Fitness (a few have left the gym) hopefully this should give them a kick up their back side to protect the interests of their customers and their business.
UKCPS are STILL giving out my tickets at my local TF. i hope i can catch them in the act!0
