    Been following this thread for a while now. Interesting reading. So isn't it tit for tat? You complain about your neighbours garden which is overgrown, she complained about your lack of maintenance. What does your lease say? Did you seek legal advice about who was responsible for what or have your lease looked at? You say that there are problems with the guttering, this could cause damp problems in your neighbours property.

    Hi iguana
    The buyers had a survey . No problems.
    The building is solid. No issues .
    If nothing is mentioned , then I'm not going to pay for
    anything that I don't need to.

    Regarding the 'neighbour '. She has had both overgrown gardens for 90% of the time I've been here .( I have a back garden.she has front and back).
    When I politely asked her to do her gardens , she shouted at me .
    That was 3 years ago ( I think ).
    6 years ago I got squirrels in my loft because of her.
    After her snapping at me, I had to contact prop mgt co.
    They sent a polite reminder to all in the close.

    When I filled out my forms got selling , I declared that I had no neighbour disputes , but I asked her to tidy garden and that was done .
    So , 3 Friday's ago, she tidies both Gardens and pathway.
    2 weeks ago I get letter from prop mgt co.
    Initially , I thought ok , if she hasn't complained I'll get fascia sorted .
    Forward to yesterday : I explained to solicitor . He said it's only a tiff .not a neighbour from hell scenario . Propery mgt co say it's nothing to worry about. So , all this extra running around and cost over a spiteful individual .
    Rather than get revenge( I may poison a plant or 2)!, I think the best revenge is to leave without the fascia being done . I haven't the money or time to get this done by October deadline . The stupid woman could keep me here , instead of her having a nice couple next door to her.
    The property mgt are slow anyway, and if they wanted it done , they should have the decency to reply knowing full well I am trying to move . I asked them everything : how much? Is it split 4 ways in cost etc. No response whatsoever

    That's it .
  • LL you are right . I will probably offer to go halfway with them .
    I don't have time to get that done by the October deadline .
    It wasn't mentions in the survey . Only that the one next door wanted to
    stitch me up , knowing full well the place is virtually sold .
    I did ask ,but the prop mgt co have not been helpful .

    The reason I left the fascia is because I thought ( incorrectly it seems) that
    the property mgt co would do the job to all flats and Bill us.
    Then if I wanted to proceed , is it split 4 ways . Why should I foot the whole bill?
    So, I'm blaming the prop mgt co for being totally oblivious to everything with no information.and the one next door for being vindictive and spiteful .
    I may very well send email to solicitor telling him to split costs .
    Then again he may have to wait to see what is said on Monday from the other party anyway . Then again , how much ? Who decides ?

    None of which really matters now, as clearly if the buyers refuse to accept the flat as it is a compromise will have to be reached, all parties have invested too much at this point to allow such a minor matter to derail the sale.

    Wait and see what the solicitor says then decide how to proceed re sharing the costs if necessary. All of this is just another part of the negotiation process.

    Ignore the neighbour issue AC. Who pays for fascias is down to property management company and lease particulars. There may be money in reserve fund or the management company may have shortfall and call on leaseholders depending on what lease says. Then it is matter for negotiation between you and buyers as to what percentage you each pay for your share. Usually there is retention from sale proceeds until management company sort out how much they want from leaseholders.

    The neighbour issue is something else's which is really just a spat. I hate my neighbour feeding seagulls but we are not going to have fight over it. Just inevitable spats when you live in close proximity to other people

    The lease is older than me , and is very basic .
    TBH , I'm only paying for insurance and ground rent ( £375/ £18 per annum )
    About 4 years ago, I got a letter saying they want to do tree maintenance and wanted me to pay Something . I have no tree and paid nothing .
    All leases are different wherever you go .
    I know that when I go to Poole , if I get a flat I will be paying around £ 1500 a year .

    I think I had to play hardball yesterday initially , as I would be pandering too much to the buyers , getting more stress trying to find a quote , getting the job done for them all within the October deadline .
    On Monday , we'll see what is said . Looks like I'll go halfway .
    Saves stress and uncertainty from both sides .
    Also, it keeps the October target more realistic .
