Have updated the first post with another video, demonstrating the problems exiting the car park... https://www.youtube.com/watch?v=6kqA9V81iu0&feature=youtu.be

I noticed it is still the same woeful signage as was there when PE were at Fistral Beach car park.

No signs at all beside the flags running along the bays outside the surf shop & toilets etc., nothing to tell you it's P&D if you miss the entrance sign because people are walking in front of it as you enter, then you park somewhere with no signs. Nothing obvious saying 'have you paid and displayed?' And no final chance to pay before leaving, no reminder signs in view. Nothing lit if it's dark!

Also no signs in the middle of the car park, only round the edges (same as PE). Woeful. Thanks for the video, IvorPEcheque.

  • I have taken the planning application for the site to the Cornwall planning office. If you check the planning portal there is no application for Smart parking's signage, which is required. But they may try and pull the 4 year re-submission rule. Even though there is not one listed 4 years ago or even longer.
Also no application for the ANPR camera. The get out for that may be it was in before 2007??

This is the pay machine we used. Spot the terms and condition sign anywhere. Please note not may cars make it easy to see lol.

They need advertising consent for signage, not planning consent.

Smart have only been involved at Fistral over the past few months, prior to that the longer term 'residents' were ParkingEye - different outfit.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi there - Well I'm another tourist that has got caught at Fistral beach.

I went down the slope for a 'look' by the time I got out I had been 29 mins. I presume the cameras are at the top of the hill? That is the entrance? It took AGES to get out of the car park as the road is narrow and 2 cars/vans can only just pass each other plus people are walking up the hill.

Any history of how smart parking operates? Court action etc....

Going to look at the popla appeal route but should I add anything specific for this site?

    Thanks

there are 4 car parks there and ivor pecheque has produced a video

1 smart parking and 3 parking eye

best to start your own thread with name of PPC and location of car park

then start drafting a popla appeal

hope you did not "out" the driver ?

in that case start with the NEWBIES FAQ sticky thread

then start your own NEW THREAD using the red NEW THREAD BUTTON

when you appeal , do not reveal who was driving , stick to the BLUE TEXT appeal

    thank you
