Guys thank you. I appreciate the time you've all put in here.
I'm just going to pay it. It's an uphill battle and for the amount of time it's going to take to pursue it it's too much hassle.
My wife is also heavily pregnant and can do with the stress.

agreed, its paying them that allows them to target other people who are ignorant of the law
I also dont think you have considered PPA over on parking cowboys yet, paying them would enable you to decide on a good defence and strategy, plus if your wife wins you can submit the invoice for payment on top of any costs too (this has been mentioned at least thrice so far in posts #9 , #29 and #56)
I suspect your wife will have given birth long before this gets anywhere near an actual court0 -

Submitting the forms and a defence doesn't oblige anyone to appear in court, you can pull out at any time up to the very threshold of the court room.
Also it might be weeks or months yet before any hearing, and if they did come up with a date too close to your wife's due date then she can request a postponement (more hassle and annoyance for VCS).Je suis Charlie.0 -
I've just spoken to a solicitor on the phone who was astounded by it all. She said they'd need to look into it further to know more about the byelaws etc.
If we weren't to dispute it, what would happen next? A court date?0 -
it would be rubber stamped by sheffield court if there was no defence submitted, so no court date at all
if it was disputed, the paper trail would start and a court date would only happen if it wasnt settled out of court by some means of ADR
an actual appearance in court is the last resort when neither party backs down and no agreement is reached0 -
I don't think they're going to be top fussed about waiting it out and fighting it. It's hardly going to be hassle to them if this is how they stay afloat.0

that is what parking eye thought about their Beavis case, so it went to 3 courts and approximately 9 or more judges and is currently awaiting a decision by the Supreme Court0
