It's conflicting with itself. That two-part sentence. It's therefore ambiguous and confusing. And therefore I take the most favourable interpretation to the consumer, which is that "Each offer ends on the date listed" and strike out the rest that conflicts with it in accordance with the Unfair Terms in Consumer Contracts Regulations and/or Consumer Protection from Unfair Trading Regulations.
I don't care. The ASA Codes, and the law, take precedence over any claim to reserve their rights. I do not suggest that there has been any breach of the Codes or the law. Merely that that's what the regulations are IMO.
Most people don't read T&Cs. The relevant information that is drawn to most people's attention is the 'get-up' of the website and the more prominent promotion that the offer ends on 6th November. In accordance with what most people see, and therefore impacts on the interpretation of the requirement of 'good faith', the information they get is that the offer is ending on 6th November and any small print T&Cs are ineffectively drawn to anyone's attention and thus let's strike them out under the Regulations. What does the average consumer (who doesn't read detailed terms) expect? And how are they treated in relation to that expectation? Was the significant matter that offers may be withdraw early promoted with real prominence and drawn to consumer's notice specifically? I would expect a prominent notice on the same page of their website, immediately around the offers, and with a red hand pointing to it and flashing towards it. Any such thing?0 -
They changed the end date earlier today from the 6th to midnight tonight
Talking of heating, am I the only person who still hasn't put their heating on at all this winter?
Nope. I haven't turned mine on either.
Noticed a bit of cold draught in the house earlier though, and discovered the source was my DS - he had opened both his bedroom windows as he was feeling hot  I made him close them pronto, otherwise I would be forced to turn the heating on as the draught was starting to make the house feel cold
He really has the seasons back to front. In the summer it is not unknown for him to still wear a jumper ...Smiles are as perfect a gift as hugs...
