Seller lied on property questionaire - Electrical fire

    2nd rule of working with electrics is to double check that the the correct circuit has been switched off.

  • What survey did you buy ? Structural or full.
    If it was a full survey I would be asking if they actually visited the house at all or used a template.

    They never offered " structual " or "full" - it was just "we can do everything and they (the sellers) have opted to use us so would you like to as well" and we agreed to this

    I will have a dig for the original paperwork we were issued breaking down all the fees. For 2k i would have expected the full report to be done.

    again im all fresh to this so wasnt expecting them to not explain everything fully - to be honest on many occassions i found the solicitor rude and abrupt - she even hung up on my partner during one call.

    No they are liable for any errors.

    Put it this way I am in process of buying and the solicitor failed to spot something that could have been a risk and highlight it. I've made a formal complaint and they have agreed to not charge all purchase costs excluding dismemberments..

    When you complain it needs to be done in the right way if you want a positive outcome.

    I think it would certainly be worth your while to contact CAB for some advice OP.

    I am running through every piece of paperwork as we speak,

    if nothing is declared or stated then i will be making a complaint - quite simply put - had we been told " your house could set on fire at any time unless you spend 4k+ fixing it" we wouldnt have said "id like to buy this place please"

    If you have no cover on house insurance for legal matters I agree CAB may be your best route although these days their advice is very limited.

    Nationwide are Estate Agents as well yes? So they did everything arranged your survey, organised solicitors etc.?!

    Fingers crossed you bought a decent home insurance.

    I know your upset and angry understandably I can only repeat my advice read your house insurance policy. For example it may also cover you for alternative accommodation, in some circumstances.

    Gather your information/evidence and be 100% sure who is responsible for what before you jump in and complain.

    Is any of the wiring in the newer colours? There was a period of overlap, but any new cable may also have a date code on it. Presence of any cabling dated later than when the seller moved in would be evidence of lying on the info form.

    The colour is exactly the same grey pvc cable - red black green wire inside. and it just says on both " made in the uk " and some other random stuff - both sets contain the same writing however couldnt see any dates.

    After reading through every single bit of paperwork - there is actually no report on the house nor its condition. I do remember seeing the report to confirm its value - which said there was some minor shift expected with the age of the house etc etc but nothing relating to electrics.

    I then found some lovely small print as always in the solicitors T+C stating "upon successful transfer of contracts the seller is not responsible for any repairs undertaking by you in the property"

    Now - say if we were given the choice to have a full report on the property ( which we thought we had agreed to) and upon the answers chose not to "inspect" then im playing the "they lied to avoid it" card

    i suppose its going to be a long drawn out case but i have much evidence to suggest they have tampered with things post 2005 and not declared this...

    I know the old sharia law allows for cutting off a hand for theft, but what gets cut off for getting a conveyancing wrong?
