Seller lied on property questionaire - Electrical fire

    They say the boiler was serviced in 2009 - and of course - "to follow"

    this would then lead me to believe either - they did have the boiler fitted as early as they state and have this serviced in 2009 or... they replaced the boiler in 2008 which the paperwork suggests -

    I think the boiler is going to be hard to prove - because of the paperwork and their claims.

    Looking at an invoice they have for a fixed pump in 2009 - this could easily relate to the service date - im finding it hard to prove them wrong on this one. - the manual dated 2008 could have been an updated version left with them in the 2009 service i suppose

    Suck it up? have you been told you are living in a death trap then to suck it up?

    I think i will be letting a solicitor follow this through as your second statement suggests...

    £80.00 to take people to court - not so expensive in comparison to the 4k plus to fix the house...

    The thing is if they answered no to 12.1 the solicitor should have advised you to have the electrics checked.

    Again if no evidence of boiler being serviced recently 2009 is a long time when they are supposed to be serviced annually. you should have been advised to have it checked.

    If you were advised to do this and didn't totally different scenario.

    For example friend is buying a 30 year old flat solicitor has advised a full structural survey and said this in writing. Basically covering themselves.

    Does your house insurance cover legal contractual problems ? I know mine does.

    I would start by phoning your house insurer tomorrow if you are covered and follow their instructions.

    and being first time buyers - thought that in the 2k costs we pid this was all covered.

    I think tomorrow i will be ringing the silicitors and the house insurance to find out whats happening

    Either way the works they completed post 2005 should have certificates and should have been declared surely or questioned by the solicitor?

    Edit - Also remember the same company represented us and them - not saying there was any foul play but... makes you wonder

    I would not contact the solicitor at this stage tbh, you don't want to jeopardise any cover you may have legally with your insurer. Read the policy carefully and see what you are covered for and if you are covered speak to them first don't do anything else. My insurer Direct line offers a helpline I think it's 24/7.

    What survey did you buy ? Structural or full.
    If it was a full survey I would be asking if they actually visited the house at all or used a template.
    I do Contracts, all day every day.

    The solicitor of the conveyance team i mean

    Not instructing one in the matter until i have more than enough evidence to have a solid case.

    I would imagine i will be met with some small print and indemnity clause from the conveyance team but this still shouldnt go unoticed by them!

    You would also need to go through the solicitors formal complaint route before being able to go to the Ombudsman.
