    I think Tesco acted properly, but of course they didn't try to prevent him walking out with the goods that he had not paid for. They waited for him to leave so they accuse him of theft.

    That's the way all the shops work.

    If the security guard had approached OP before he left the store with "excuse me sir, but have you paid for those magazines", they could have prevented what they saw as attempted theft.

    Problem is, if they took that approach, there would be no disincentive preventing any dishonest person from stealing.

    Until the person leaves the store with the item then there is no possible offence.

    While still in the store there is always the possibility that the person will pay for the item so to remove doubt they allow them to leave

    Not strictly true. Someone caught removing security tags etc and then concealing an item wouldnt really have much of a defence.

    But we're not in a court of law, we're using language in an everyday way.

    (Unless, if you came home early and found your wife in bed with another person, you'd accept that she was innocent of adultery because it wasn't proven in law?;))

    No we're not in a court of law-I think the phrase is " kangaroo court".

    OP if you leave a shop without paying then it's theft, consider yourself that no charges were made.
    Why pay full price when you may get it YS ;)

    It's not really stupidity to say walking out of a store with items you haven't paid for is theft.

    Obviously it's not 100% legally accurate and as the police didn't progress with it we will never know if the OP would have been found guilty of theft in a court of law.

    Personally if it was just one magazine I would agree it was absentmindedness on the OP but now they've said it was £14 worth that's 3-5 magazines which is a sizeable weight. I don't see how you can walk out of a store with that many magazines by mistake.

    Yes it is.
    The police at first offered a fixed penalty, then they viewed the cctv and dropped that suggestion as theft had not taken place.That would have been progressing with it. Do you think the cps are going to take a case to court where the security guard has lied..Duh..;)

    The police do not decide whether or not a theft has taken place. That is for the courts to decide.

    This was a petty crime and so they wanted the OP to take a fixed penalty to speed up the process, when he refused they viewed the CCTV footage and obviously decide that it didn't look like theft but that doesn't mean it wasn't.

    I could deliberately walk into tesco now and mirror the exact movements of the OP and deliberately walk out with £14 worth of magazines. That would be theft as I would mean to do it. The CCTV footage would be identical to the OP's. Therefore it cannot be used to either prove or disprove that a theft took place.

    The police assess the evidence and bring it before the court if necessary . They assessed the evidence and found a lieing witness.

    Yes you could do that-but you couldnt recreate the lieing security guard ..The scenario is not the same.
