You're not complaining to the DVLA about a parking ticket.
You're complaining that there has been a breach of the Data Protection Act by the DVLA in relation to releasing your data to a company that is acting outside of an AOS membership's Code of Practice - as confirmed by the BPA Ltd.
UKPPO MUST be a member of an AOS and follow their code of practice. The BPA have confirmed that their actions are not part of their Code of Practice as they relate to PENALTY Charge Notices.

You need to complain to the DVLA about the breach of the Data Protection Act. They are the ones who have breached it, if they have issued RK data to a firm who is ostensibly acting outside of the provisions of the AOS to which they are required to belong in order to access that data.
It might be an idea to get the BPA to clarify that UKPPO are - at this specific location - not acting under their AOS Code of Practice.
With that confirmation, you then raise the official complaint with the DVLA that UKPPO are obtaining RK data outwith of any compliance with the Code of Practice of the AOS they are supposed to belong to in order to access the DVLA database.Je Suis Cecil.0 -

Just to add and clarify on my post above.
The membership of, and adherence to the Code of Practice of, an accredited AOS, enables the PPC to obtain data with a 'reasonable cause'.
If these PENALTY Charge Notices issued at this location do not fall under the BPA's AOS scheme, then they do not have 'reasonable cause' to obtain RK data in relation to these tickets, and every time the DVLA gives them the data, they breach the DPA.
There is also, as Castle says, the separate issue of UKPPO not being a BPA member. I think - although this argument is perfectly correct - there would be wriggle room for a BPA cop-out excuse to get round this, but I cannot see any wriggle room for the AOS/reasonable cause argument with the DVLA over the Penalty Charge Notices. Especially if you can get the BPA to clarify further their earlier statement that these fall outside of the AOS CoP.
No doubt they'll get creative though.Je Suis Cecil.0 -

My money's on the DVLA saying that they have reasonable cause under the bylaws, but let's see.

DVLA just bounced back my email this time giving me the "Do not reply to this email; " even though they had replied on it on Monday ?
I must wait 10 days for them to respond?

Good morning
We are not a regulatory body nor a legal entity. If you feel there has been a breach of the Data Protection Act you should report this directly to the Information Commissioner’s Office as previously advised. Penalty charge notices are issued on behalf of Councils and Byelaws and are covered under the Road Traffic Act and statute. The BPA Code of Practice is not relevant to these tickets.

They'll try.
You can go back to the BPA and tell them that one of their operators is misusing their KADOE contract and association to pursue tickets which are unlrelated to byelaws and are managing to bypass both systems and bring the parking industry into disrepute.
You should also be asking the DVLA under which circumstances the PPC has asked for your details - breach of byelaws or via KADOE for parking?0
