Hello Again
Trying to attach, the letter(sorry) containing the response from UKPPO to my MP (details removed)
(can I do this on this thread) ?
I agree with Bazster in 191 above.
Cheetham is avoiding the issue here.
I have had no reply from the DVLA about the points I raised courtesy of Bazster 186 (sent 19th Nov) and no reply from BPA Peter Beasley sent (10th Nov) courtesy of coupon mad 170, asking to refer the matter to a Ms Gemma Dorans and also what now where my options with POPLA and how to go about receiving POPLA.
I also asked Mr Beasley to confirm receipt of my email - nothing???
So, if your interested I would very much like your opinions on the letter received by my MP0 -
Take a photo of the letter (or scan it) then host it on a free photo hosting site (Photobucket or Tinypic), copy the URL, paste it here. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hello Again
This is the latest response from DVLA following my most recent complaint.

Dear Mr /////////////
I refer to your e-mail of 17 November to Mark Lewis regarding the Newcastle Airport Byelaws. I have been asked to review the correspondence.
There is very little I can add to the previous replies you have received on this issue. It would not be the role of DVLA to obtain legal advice on the Byelaws in place as the Byelaws would be a matter for the Airport itself and the Aviation Division of the Department for Transport. DVLA’s role is limited to the disclosure of vehicle data under Regulation 27 of the Road Vehicles (Registration and Licensing) Regulations 2002 following alleged non compliance with the terms and conditions applying on the land.
I should point out that DVLA cannot determine guilt or liability of any individual when dealing with requests for information. The matter of guilt or liability in disputed cases would ultimately be for the Courts to determine. Under the Regulations, DVLA discloses keeper data as a first point of contact to help investigate and establish where liability might lie. DVLA would not be the appropriate body to determine liability, as its role would only be to assess whether there was reasonable cause for the data to be disclosed.
Yours sincerely,
Jamie Pickering

Re DVLA, Request that your complaint be referred to an Independent Complaints Assessor.
Re your MP: point out to him/her that the response from Cheetham completely fails to address your complaints regarding (i) the non-applicability of the airport byelaws (ii) UKPPO's complete lack of statutory powers to enforce statutory byelaws (iii) UKPPO's complete lack of authority to operate at the airport (iv) that this is really a civil charge disguised as a byelaws penalty and (v) that for a private company to demand money on its own account in lieu of a prosecution (which it has no powers to bring anyway) would appear to constitute several criminal offences.
Ask your MP why, against this background of dodgy and potentially criminal behaviour by UKPPO, DVLA persists in handing out registered keeper details to this operation.Je suis Charlie.0 -
Well if there is anyone in Newcastle that is interested, there is an Airport Consultative Committee and they have their own page on the Newcastle Airport site.

If I were a betting man, I'd say there is a public meeting coming up in a couple of weeks if someone wants to contact them.
JLA were not amused when someone with a bit of parking knowledge turn up to theirs.

Byeaws?
The notice to which is referred?
Laughable.
Sign also refers to a default £1.50 admin fee for card payments which is illegal.
And as others have stated sign is for UKPPO not UKPPO Ltd.0 -
Hello again
I got a reply from DVLA today telling me my complaint has been referred to an Independent Complaints Assessor.
Also met with my MP .Sent all the requested information but more importantly the succinct points around the nature of UKPPO, S business at Newcastle Airport.
Nothing back from ICO yet or BPA.
It is 16 days since I asked Mr Beasley to confirm receipt of my email and refer the matter to M's Gemma Dorans ?
Keep you posted0 -
You are doing a great job Keith, impressed by your tenacity.Je suis Charlie.0
