  • The introduction of a bus lane and/or a cycle lane with a solid white barrier running alongside it does change the classification of a road.

    The Highway Code was first published in 1930, almost 40 years before the first bus lane or cycle lane was introduced in the UK.

    As I stated earlier in this thread, there has not always been bus lanes or cycles lanes so, therefore, the Highway Code has had to be updated to include newer rules of the road.

    The heading "Dual Carriageways" in the Highway Code clearly defines what a dual Carriageway is and having a central reservation is not the only requirement.

    Before bus/cycle lanes then this would have been the case.

    "Central Reservation" is not even entirely accurate, as I also pointed out earlier.

    On a three lane dual carriageway the "Central" reservation won't even be centered, it will be either 1/3rd, or 2/3rd's, of the road, depending on direction of travel.

    It appears some members on here should get up to speed and ditch their horse and cart.

    Can you please answer a couple of the questions already asked many times:

    Are you still asserting that the place where the OP's incident took place is a dual carriageway?

    Can you also please confirm that this streetview image is the point on the A48 where you claim that a single carriageway road is a dual carriageway?
  • Anyway OP, this thread has been hijacked initially by those who immediately dismissed your situation.

    Please take note of the following, as I stated earlier, it appears you have several grounds for appeal-

    1 You have not committed the offence as alleged.

    When you entered the box junction the van in front of you was moving, as was the car in the next lane.

    As such, you were not committing an offence, even when you subsequently stopped in the box.

    Had you entered the box with the van already across the box junction, blocking the exit, then that would be the offence.

    2 There are double yellow lines running through a part of the yellow box junction, (where the bus lane markings begin). Possibly not enforceable anyway. You need to check that the council have their paperwork in order for this box junction.

    3 There were two lanes open to you, not just one, regardless of what lane you were in when entering the box junction. I believe the car to the right of you blocked your exit by taking up more room than was needed.

    4 Being behind a large sprinter van will obviously obscure your vision going forward. There are obviously traffic lights ahead of the queue of traffic and I, and everyone else, will have been in this situation where such a large vehicle does not enable you to view traffic lights.

    This alone is a mitigating factor.

    Anyway, we're going round in circles here.

    You've offered your opinion, I've offered mine, and others have offered theirs.

    That's all they are... opinions.

    The Op probably has enough information to decide his next action.

    As you apparently have no intention of supplying a link to you A48 stretch of road, I think I'll leave this now.

    Which means the van hadn't already filled the space, which means the exit was clear and both vehicles were moving.

    That is the test, there is no offence.

    Had the van already been across then that would have been different, the OP would have been entering the box with his exit blocked.

    This is not to even mention the other lane to his right that was also clear and which he was perfectly entitled to drive into.

    Your opinion is wrong, simple as.
