Question to swallace78 -
Hi, what address did you send this letter to?
I'm in a similar situation to you - I did not realise that parking restriction was enforced, spent around £1000 on the day - in various shops, and for lunch - only to be treated to a parking charge, ,over a month later!!!
Apparently I was 15 minutes over the 3 hour alloted time. And my parking charge is conviently sitting at £160 right now.
Thieves!
Many thanks!
swallace78 hasn't visited the forum in over 7 months, so most unlikely to pick this up now. You could try to PM him/her, they will get an email to let them know they've received a PM.
Given the amount of your spend, have you contacted the retailer(s) to get their help in getting this charged cancelled?
If they won't help. I'd seriously be looking at what their returns policy says, as I wouldn't want to be providing any patronage to any outfit that allows parking companies to scam their customers - especially high spending ones.
More help will need to be via a new thread of your own please. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Wow, a bit harsh - it makes it sound like this is a hostile place. There was only one who was cantankerous, our retired diplomat 'The Deep' - and it's only usually after a heavy dose of sangria, the night before, at his Costa Blanca retreat.

Did you have any luck with your PCN being cancelled? I've just received a PCN letter in the post from same company for Goldstone retail park being 15mins over allocated time (can't prove I was there within the three hours but I'm usually vigilant about things like this!) & hoped your letter/email was accepted?
Thank you :-)0 -

If you simply send the blue writing appeal in the NEWBIES sticky thread to CEL, they will cancel.
I know it's CEL at the Goldstone Retail park because I know the place, the old Goldstone Ground and I'm a Brighton fan so it's a very memorable site for me. DO NOT write about what happened. DO NOT imply who was driving.
DO complain to ToysRUs, PetsAtHome, etc!
CEL ones are easy to appeal, if you do get a rejection letter, start your own new thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I am in the same position at the same car park.
Can I just check that this is the right template before sending it.

Dear Sirs
Re: PCN No. ..........
I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers before they park.
Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. I believe the driver may well be eligible for cancellation and you have omitted clear information about the process for complaints including a geographical address of the landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
Please find attached a photo of your sign, which is clearly positioned to high to be seen from a drivers point of view upon entry to the car park.
I have kept proof of submission of this appeal and look forward to your reply.
Yours faithfully,0 -
Yes of course, there's never a need to copy the template elsewhere. No need to check. It says it's the appeal for BPA members and it's the only appeal in blue writing in the sticky.
Good luck, come back if you need a POPLA appeal but start your own thread. Also complain to the retailers as they can ring up CEL & cancel these 'charges' in seconds.
