  • Hi Guys, I sent CEL the template letter with my other complaints listed on the 11th and so far so quiet, no response of any kind. I also contacted Jones Lang Lasalle the agent who have studiously ignored me. I'll optimistically continue believing no news is good news and post if I hear anything.
  • Received a letter today, it made no comment on the appeal simply stated the penalty was cancelled.

    I've received an invoice from Civil Enforcement for parking my car parked for over three hours at Hove Retail a Park in August 2015.
    I send an appeal letter stating what happened, my baby was poorly and unsettled. I had to feed and calm her before leaving. My mum was with me and she had also parked her car so she's also been fined. She was helping me so I feel really bad.
    I didn't send a template letter from MSE but an email. What do I do now?
    A, the signs are rubbish. You can only read them if you walk up to them.
    B, There's no big signs stating your vehicle will be recorded entering and exiting the car park.
    The letter I got back from them wasn't personal just stapled a list of questions and answers and that I can pay the reduced rate if I pay within the next 14 days or appeal to POPLA. Who?
    The email I sent was for both my mum and I and my mum hasn't recieved any thing from them so I expect they have dismissed and will start chasing her invoice up!
    This is such a rip off! There was no way we wanted to stay there for that long and all the time we were there a trolley was in the parking space in front of my car. Bet that's not getting an invoice!!


    What do I do now???

  • I sent them the email below, worth a try. If it fails you can still go to POPLA )parking on private land appeals) and hope for the best. I think the legalese in the letter below is enough to make it not worth their time pursuing it.

    I challenge this 'PCN' as keeper of the car, on these main grounds:

    a) The sum is disproportionate, does not represent a genuine pre-estimate of loss, nor is it a core price term.
    b) The sum is extravagant and unconscionable and cannot be justified.
    c) There is no evidence that you have any interest in the land. I will complain to the landowner about your aggressive ticketing.
    d) Your 'Notice' fails to comply with the POFA so there can be no keeper liability.
    e) I believe that the signs are ambiguous, there is a Free Parking sign at the entrance (photo below) and the predominant purpose is to deter so there is no contract to pay this charge, which is a penalty.
    f) The occupant was legitimately using the car park.

    Formal challenge
    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 or cancel the charge. I will only appeal further if you offer POPLA, the only independent ADR with a scrutiny panel and trained Assessors. The 'IAS' offered by IPC firms will not be used, for well-documented reasons.

    ''Drop hands'' offer
    The charge is baseless but I realise that you may have nominal postage costs. Equally, I have incurred costs for responding to your junk mail dressed up to mimic a parking ticket. It is clear that my costs and yours, at this point, do not exceed £15 so this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the spurious charge within 35 days and I will not pursue you for my costs.

    Breach of CCRs
    I hereby give notice of withdrawal from this alleged 'contract' which was never properly offered nor expressly agreed. This 'contract' is cancelled and any obligations now end.

    I have kept proof of submission of this appeal and look forward to your reply.
