I was always under the impression that if they have taken to money, they have entered into a legally binding contract. Is this correct?
My experience of other misprices is that the retailer can and will generally get out of it, even if the payment's been taken. They'll just send out an email saying over the next day or two that they don't have the stock to deal with the unexpectedly large volume of orders and refund. They're unlikely to mention any misprice either of course. Fingers crossed still but I'm not optmistic!0 -
I ordered one for my dh yesterday. I've just spoken to him and he says he wanted one the size of a fag packet and this one'll be too big for him to carry about. Ungrateful sod!

As far as I can see I was the first person to ordered before 11:30am as I had Email at that time.
I was hoping mine would slip though but once they get posted on sites like this that's the death nail.

Has anyone been charged for this yet on their account? Just checked my credit card online and it is showing on the 'account balance' (which was zero before so I know 100% it is the dell order) but not on the list of transaction (which I asssume ahould appear after the normal 3 days or so).

Also, at the bottom of the order confirmation pdf it says 'Dell will not be responsible for typographical, pricing or other errors and reserves the right to cancel any orders based on such errors.', yet on this same email on the T&C's pdf it quotes 'Dell accepts Customer’s offer to purchase under this Agreement & makes a binding Agreement by issuing an Order Confirmation. Order confirmation is binding except, in the case of consumers only, where there is a discrepancy between order confirmation and what consumer ordered and where discrepancy is unacceptable to the consumer.'
Anybody have any ideas where we legally stand on this one?
Dell will have "reserved" the funds from your account - hence showing in your available balance - but will not actually charge your account until they ship.
This is common practice to make sure you can afford the item at point of order.0 -

I got my order confirmation at 2243 last night. Estimated delivery on or before 21 Aug.
