    Are there any legal eagles out there?

    Once DELL have reserved funds on a credit card havent they accepted an 'invitation to treat' and therefore a contract is established?

    Isnt it up to DELL to make sure before reserving funds that they have got their sums right?

  • Why not have a mass phone in to Trading Standards on Monday morning. If enough complaints are made, TS will have to investigate. It's still unlikely to get anyone a hard drive but it'll cause Dell a bit of work and embarrassment when it hits the press.

    Oh I see that we have moved to the " Legal Challenge Mode " now, oh so predictable.

    Everyone is now in the " Let's Sue Dell " mode.

    All of the unqualified legal experts will now have their say.:rolleyes:

    Of course the truth is, everyone will have a whinge, but nobody will actually do anything about it, so why not just move on.

    Do you think someone's gonna do that on their own time? Out of the goodness of their heart? My guess is their wages are gonna come out of our taxes "dood".

    But they have taken money from my bank account, not just reserved it. Surely that means that a contract has been formed?

  • I have had no response from Dell at all. An e-mail explaining that it was a mistake and they are sorry would be something. Or maybe an offer of a discount on the proper price ??

    I tried to press action on an earlier price mistake. One clause is that if it's obvious that there was a price error (like a major price difference), CAB told me chances are it would never hold up in court. At the end of the day, it would have to be you convincing a judge that they need to honor the deal. Nobody's going to automatically make them send you a hard drive.

    If you think it's worth your time, money, and risk that the judge won't side in your favor, to get this hard drive, then by all means go for it. However, chances are it's not, unfortunately.
