Please could peeps comment on my letter to Steve Clarke of BPA:
Dear Mr Clarke,
I recently received a letter from POPLA saying that my appeal has been adjourned until Monday 9 November 2015. The reasons given were that it appeared to the Assessor that my Appeal raised the same issue as ParkingEye Ltd vs Beavis and that there was no other ground upon which the appeal could be determined.
This is despite the fact that I'd argued in my Appeal that Beavis vs PE didn't apply - because the driver had overstayed, having paid, in a ‘paid’ car park, whereas Beavis overstayed in a ‘free’ car park.
Furthermore, the 51 page Evidence Pack' from ParkingEye (which arrived on the very date that my original Appeal was due to be heard -3rd September!) contained a ‘Witness Statement’ from the Manager of Newquay Golf Club saying that he was authorised by the Trustees of Newquay Golf Club to state that the operator (Parking Eye) have written authority to issue PCNs.(In fact, the Witness Statement itself arrived several days after the original 'Evidence Pack', on 7th September!)
I reiterate, this party is not the landowner and has provided no evidence to substantiate that he has the authority of the landowner (which may or may not be the trustees of Newquay Golf Club on whose behalf he supposedly acts) to authorise Parking Eye to offer contracts for parking in their name and issue parking charges for breaches of any supposed contract or have the authority to litigate in their own name for breach of contract .
I do not believe they do and this supporting document carries no weight whatsoever to disprove me.
Hence I disagree with the assessment by POPLA that there are no factors which distinguish my case from Beavis .
Please therefore would you supply the name of the person who made this assessment, together with a copy of it.
Please could you indicate whether:
· the old POPLA or its successor (new POPLA) will be giving the final decision
· there will be a full assessment of all the issues or…
· is the plan to simply using the Beavis judgment to decide in my case?
If the latter is the case, then I must refuse to accept it as all the points I have made in my Appeal will not have been addressed in writing .0 -
Really? Has anyone admitted to being the driver (as opposed to the keeper)?
This might need to be reworked - and amended on here!
