I just tried to track my appeal ast POPLA, as the hearing was due on 3rd September, but I've heard nothing. I had this response:
"Sorry, the information you have provided is invalid. Please check the details you have entered"
I had to enter the 10 digit POPLA Verification Code and a password. I had entered what I thought might be my Password. I then clicked 'Forgotten Password' but got the same message.
Any ideas? Could it be because POPLA Appeals process has changed?
You can't track an 'old' POPLA submission on the 'new' POPLA system; they are different animals. Your case will be one of the 4,000 odd currently stayed for Beavis and we don't know who the BPA will get to address that. Nothing until after Beavis anyway.
And if you emailed '....@popla.org.uk' you were emailing old POPLA who would not have a clue about the new tracking system, which isn't relevant to your case anyway. The new POPLA pages & website (info@popla.co.uk)are not relevant to you.
The 4,000 stayed cases will have to wait for POPLA then see what gets emailed out and by whom, after that.
So get on with your life and see what happens in Oct/November.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, good advice Coupon-Mad; exactly what I intend to do. I feel the time and effort I've put into this Appeal just hasn't been cost effective, even assuming that I win. It's the principle that counts. I want to see PE driven out of every car park in Britain!0 -

Just to say that I have today rec'd an email similar to other people on this site:
Dear XXXX
As you may be aware, a case concerning parking on private land, ParkingEye Limited -v- Beavis, has now been heard by the Supreme Court of the United Kingdom. However, a decision is not expected for some time.
Where either party has requested an adjournment or where it appears to the Assessor that a POPLA appeal raises the same issue as in the above case, and there is no other ground upon which the appeal can be determined, the matter will be adjourned.
Accordingly, your appeal is adjourned to a provisional date for determination of Monday 9 November 2015.
In the meantime, no enforcement action can proceed once a case is registered at POPLA, before the POPLA appeal is determined. Further, there is absolutely no requirement to pay any sort of ‘administration charge’ to the operator, in order for the case to be taken out of the list.
You should be contacted again after the decision of the Supreme Court is handed down”.
This is despite the fact that I'd argued in my Appeal that Beavis vs PE didn't apply because I overstayed, having paid, in a paid car park. The 51 page Evidence Pack' from PE arrived just at the time of the changeover at POPLA, and I contested the validity of their 'Witness Statement' from the Secretary (I think it was) of Newquay Golf Club, as described in earlier posts.
I've had no message from POPLA to say that they weren't accepting new evidence (as I've read has happened to other people on this site)

Hi All, So it looks like I'm the latest victim of the parking eye asking for £100 for parking at Towers road park Newquay. My car is a company car so I received the letter showing my car entering and leaving the site. I entered at 11.56 after being guided in by the large signs directing me to parking. My girlfriend walked over to the machine and then realised you had to enter your car reg. As I had just changed my car she walked back to the car noted the reg and entered paying for 2 hours. We got back to the car park before the time was up to avoid a fine after a lovely beach walk I had to change my shoes remove some extra layers and look at sat nav to get out of Newquay being from Essex we didn't know the roads at all. The letter sent shows my car leaving the carpark at 14:07 .As soon as I got the letter I looked in the car and found the pay and display ticket showing parking was covered 12-14:00. The letter I received is saying I was technically on their land for 2hours 11 mins and I only cover 2 hours. I couldn't believe this and was shocked at this parking system that I've never encountered before. After reading a number of threads I feel I should appeal but wanted to check with you guys I had a good case or if I stood no chance . any advice appreciated :-).0

Sorry, but not surprised to read of your experience at this car park.
However, you'll need to start your own thread to generate a response. However, this will be to read the 'Newbies Sticker' and send a letter to PE to appeal their claim. This is solely to obtain a POPLA code, so that you can send a targeted Appeal to the organisation that has replaced POPLA. You need to send the letter advised in the Newbies Sticker verbatim - no changes or additions whatsoever.
Could I also ask you to send a strongly-worded letter to the manager of Newquay Golf Club complaining about the dubious behaviour of the parking management company they allow to infest their car park. He is:

Why not e mail POPLA and disagree with their assessment of the situation . Your case has many areas that can differentiate it from Beavis and you want those areas considered and adjudicated on and not just swept under the carpet in the event Beavis loses0

Well, I'm not sure who to email, as apparently the old POPLA email innboxes are not manned. Also, I can't understand why I have never rec'd correspondence from POPLA to say that it's changing to a new system.
When I responded to the 51 page 'Evidence Pack' that PE sent both them and me, I'm not convinced they rec'd it, because it was exactly at the changeover time. When I tried to track my Appeal on the POPLA website, I couldn't - it wouldn't recognise my user name or password, or enable me to create a new one. In retrospect, this was because POPLA had already closed down, but as I said at the start, I'd rec'd no informnation from them to say that this had happened.0 -

1. You disagree with the assessment by POPLA that there are no factors to distinguish your case from Beavis . Ask for the name of who made that assessment and a copy of it .
2. Ask whether old POPLA or new POPLA will be giving the final decision and is there going to be a full assessment of all the issues or are they planning on simply using the Beavis judgment to decide in your case in which case you will refuse to accept it as your other points will not have been addressed in writing .0
