    This is what someone else has just written to Barry Beavis' Facebook thread:

    "I was in Newquay a few weeks ago, It was a parking Eye Car park. It stated not to wory if you return late, you can pay for the extra time you used! Now if all car parks did that......."

    I guess she intends to finish this sentence by saying 'we wouldn't have anything to worry about' ! :-D
  • Well. I've just returned from 2 weeks holiday to find the 51 page 'Evidence' from ParkingLie to POPLA in my Inbox.
    Salient points are:
    1. PE have attached a document from Mr Peter Batty, Manager of Newquay Golf Club) to say that the Operator (PE) does have athority from the the Landholder (Trustees od Newquay Golf Club) to undertake parking managementr and control. (I'll try to copy and paste this below FYI).
    2. 'Evidence G' of their 51 page document says, 'System generated print out showing that the vehicles Registration HF.... was purchased at 12.40:00 for £2.60 and HG... was purchased at 1640.00 for £200. therefore insufficient tariff was paid on the date of the event. (i.e. The driver had indeed miskeyed the VRN on one occasion)
    They produced a photograph of their parking tariffs whic said:
    Up to 4 hours £4.80
    Up to 5 hours £5.50
    So, it looks as though the driver had indeed underpaid. However, my recollection is that the driver and passenger did discuss at the meter what the due fee was, and collectivelt thought they'd paid the appropriate amount.

  • Oops, '.. was purchased at 1640.00 for £200' is supposed to read '.. was purchased at 1640.00 for £2-00'!
  • Post up a pic of the sign they are relying on in their bundle

  • So why would you have paid £2-60 and £2-00

    To POPLA

    The witness statement provided by Parking Eye is signed on behalf of Newquay Golf Club . This party is not the landowner and has provided no evidence to substantiate that they have the authority of the landowner ( Which may or may not be the trustess of Newquay Golf Club on whose behalf they supposedly act ) to authorise Parking Eye to offer contracts for parking in their name and issue parking charges for breaches of any supposed contract or have the authority to litigate in their own name for breach of contract .
    I do not believe they do and this supporting document carries no weight whatsoever to disprove me.

    This may not be the explanation BUT we parked on Tower Road Mini Golf & sh!tty cafe car park in September 2013. We wanted to pay £3.80 for 3 hours. The first machine was playing up a lot (some people got that fed up they actually drove off & left the car park) so we went to the one nearer the entrance.

    The machine was still playing up (coins dropping straight through) but we finally thought we had done it. We were walking away with the ticket when Hubby realised only £3.30 of the coins had registered so we only got 2 hours. He did press a button and got the 50 pence back but even so it still printed a ticket for a non-tariff amount.

    And we overpaid 50 pence for 2 hours parking.
