i wish the post could be reinstated. I did give in, i just wanted it resolved for my daughter though as she was going through a really bad phase at this point. i was promised by the director things would change etc etc. a year on nothings changed apart from the name. still the same rude staff, have tried contacting through facebook/email- they deleted my post on facebook and blocked me! afraid they dont give a monkeys about the disabled people they sell products for, just profitEven a stopped clock tells the right time twice a day, and for once I'm inclined to believe Withnail is right. these emails referred to a lightbulb for 19.99 which failed within 2 weeks. i quoted the SOGA this was the friendly reply from customer services at cheap disability aids;
The sales of goods act within the first six months refers to Inherent faults,an inherent fault is something which was present at the manufacturing point and at time of sale.
At the item clearly worked at time of sale the bulb was working and you have stated this.
Therefore this would discount an inherent fault.
We will happily defend in court and our rate of £150 per hour which is the standard directors rate will be added to a counter claim for directors time.

Im having trouble with this site (not for the first time). Placed an order 31/05/15 selected standard delivery (3-5 days). still not received. chased company and was told to wait until the 8/05/15 because they could not report parcel missing until this date.Ive waited and waited and sent emails. After the 8th theyve started ignoring me, my parcel has still not come. Im really angry as it was for my children with special needs and its things that they do need urgently. Are my next options small claims court? I have tried to be amicable but they aren't even responding to me now.
Well, you should send a Letter Before Action if you want to go down the route of Small Claims (two copies, different post offices, proof of posting but not tracked so they cannot reject).
When you say they aren't responding, how have you tried - do they have a telephone number on the website that you can call?
I'm just wondering whether your frustration/annoyance is more than usual because of your previous experience. Not that I'm defending them, I've heard many other horror stories. But curiously I've never had a problem with them - have ordered a few times, most recently was Monday last week and the goods arrived intact, working, on that Friday. That's bull lad!!! Did they really send you that email?! Over a 20 quid lightbulb?!
Points:
1. A manufacturing fault can be present even if it isn't visible when purchasing!
2. 150 pound an hour charge for them to defend it in court?! You aren't contracting them when you summon them to court. They can't charge you to take them to court!! Plebs. IF YOU LOSE (which is unlikely, as they have to prove that it wasn't an inherent fault) then they can only bill you for REASONABLE COSTS and it is only under exceptional circumstances they could get you on "lost wages" especially if you can try and make some effort to request a suitable date from them etc. Even so, do they have evidence that the director is on 150 pound an hour? That would put the companies' director on about 100k to 200k a year depending on hours worked - and bigger companies don't pay their director that much!!!). They likely wouldn't get anything for defending a claim, other than the legal costs to you and making you keep the bulb. That's the worst case, the best case is that you get a full refund and some reasonable costs reimbursed.0
