    By the template or just ignoring them? or something else?

    Just sent off the template dispute so will see what happens. I will likely just pay and move on if its denied. I wish I had the time to persue but will cost me far more doing that than just being done with that unfortunately. Which sucks. Because I hate the rediculousness of it.

    My second ever Parking 'fine' this. First one was 6 months ago while giving blood.

    the above means that any competent person with a bit of time and effort can "beat" these numpties at this parking issue topic , using reasoned legal arguments at popla

    for those who are nervous or cannot take it in, rather than pay up they should consider paying a competent person to do it for them, the reason being the outlay is a lot less

    the best service for that paid for appeal service is PPAL over at parking cowboys website

    therefore, instead of paying £60 to £100 , you pay say less than £20 and somebody else does all the work for you

    I would encourage you to do this for yourself, for "free", but there is a bespoke service you can pay and save money compared to £60 or £100

    the choice is yours

    But even so my thoughts are if they do it for me, and lose.. then i'm paying £20 plus the £60-£100 fine.

    there is no fine, its just an invoice

    if they take on the case, check their responsibilities, did you read the info (terms and conditions) on the site I mentioned ? or are you making assumptions here ?

    they say they only take on the case and charge you if they stand to win the case

    smart parking is specifically mentioned

    even if you lost (unlikely), you still dont have to pay smart parking unless it went to court in the next 6 years, you lost in court, and a judge says you have to pay smart parking !

    They are known as 'not so smart parking' for a reason.

    I can average 3 tickets a week from this shower, and no, i don't pay them anything.
    any hint of controversy and they back off. They don't want to be answering to a certain major retailer about sharp practices, too much to lose.
  • Hi all, I'm following this thread as I have this week received not one but two parking tickets from Smart Parking at Fistral Beach. I am furious because (although I admittedly didn't read the parking notice in the car park at the time) I have a valid disabled badge which was placed on my dash board on both occasions. Now surely if the car park is the property of the council (but is leased to these morons) ... I should be able to park free of charge with the use of my disabled badge. When I received the first ticket through the post, I immediately went through the appeal procedure on their website, which states that I was parked for longer than my ticket allowed me ... therefore they are acknowledging that I had a ticket, despite not accepting disabled badges within their carpark. I explained that there are three hours free parking with the use of a DB and their website stated that I was only there for 2hrs18mins. Now I have two £60 and have no clue where to begin in telling them to shove it! I do not want to give in!! Thanks in advance for any replies, advice would be greatly appreciated.

    2) read and follow the NEWBIES sticky thread near the top of this forum

    then come back if you need further help, in your own thread though, not this one

    ps:- its nothing to do with the council, which is why its a private parking company monitoring it
  • Hi Kelly, follow the advice above, and you'll get loads of help.

    The land is owned by the Council, and has been leased to The Briant Family on a 125 year lease I believe. The lease is reviewed every 5 years. The council don't really want to know.

    I couldn't find any planning permission for ANPR or signage at Fistral Beach car park.

    I did find a request to Cornwall Council from Feb. 2014 requesting any planning permission that applied to the car park.
