Think this is the first case from Fistral that I have seen so since Fistral sacked Parking Eye and brought in Smart in its place.
You need to spend a bit of time in reading the Newbies thread carefully. It takes a little time for the info to sink in.
Also, although it is Smart rather than PE, its worth doing a search on here for "fistral" and going through previous cases there.
Once you have read them in conjunction with the Newbies thread, you should have a pretty good idea of where you are going with this.
You will get help on here, but there are too many threads for the regulars to keep up with, so you do need to do a good bit of the legwork yourself.Bournemouth - home of the Mighty Cherries0 -
Complaints to the owner - Jon Briant - he sacked off PE and thought Smart might be a better solution. WRONG, same sh/ite, different day!
Complaints to the local Press.
Complaints to the local council.
The latter two are previously p/ssed off with the situation under PE, so you should be pushing at an open door here.
All the above in parallel to dealing with things as per the NEWBIES FAQ sticky, not instead! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for that. Can they legally do anything if I ingore or do they just send empty threat letters?
I would love to battle this, especially since the car was not parked.. But I just dont have much time to bury into it and think maybe just pay the £60 and move on?
Then again I didnt want to if its just a pointless scam0 -
Pay them £60 and it gives them encouragement and resources to pursue and harass yet more victims.
Do you really want to succumb to an outfit whose only source of income is from people they can frighten into paying them extortionate amounts of money? Send it me instead, that may make it more stomachable for you?
Ignoring this is the last option you should employ. They have up to six years to 'legally do anything'.
Kill it off now via complaints and POPLA. Get it out of your life. Make a huge fuss in your wake! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Ok will do.. Should I bother disputing with them direct? Or just contact Jon and popla? Just feeling lost where to start and what to do. Need a checklist of who to contact and what to say haha.
Will have a read through some stuff tomorrow but dont have much time to commit to it0 -
You need to follow the NEWBIES FAQ sticky which should guide you through this. Do not ignore the PPC, you need to engage with their appeals procedure.
If you don't have much time to commit to it, who do you think should be dealing with this for you?
There are 'paid for' services. You need to use Google to find them. But plenty of research to make sure it's some organisation you can rely on. Try Googling 'Parking Cowboys! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Some of us thought it may have been a fresh start, but, unfortunately, loads of Fistral threads on the forums in the last week or two...
Council can't give a toss.
The operator is Jon Briant, Parky has his phone number on his web site.
His daughter works in the surf hire shop downstairs.

I am sure that Fistral Neach is a very nice beach, but £5 to park one's car for three hpours is taking the mickey. Here, on the Costa Blanca, there are many many superior beaches where on can park for free, here is one of them

Even on those beaches which are metered, if you overstay, the fine is €4.50, which you can put into a meter. Why is everthing such a rip off in Rip Off Britain? You never know how far you can go until you go too far.0 -
I believe the land is owned by the council, who have leased it on a 125 year lease, with reviews every five years. Historically, the council seem to be a little.....uninterested, in the activities of PPC's on the site.
