My opinion is that you should appeal to the IAS. The reason being that, if it is a refusal, it will be unsigned, and so flawed in law that if you showed it to a judge, he/she would agree that the PPC did not offer a fair appeal system, and immediately find for you.
AFAIAA, no PPC has dared to bring a case to court where an IAS refusal might be produced.You never know how far you can go until you go too far.0 -
I too would appeal to IAS. Even if there is only a 20% chance of being successful, it's better than nothing...... If your IAS appeal subsequently fails, then go into ignore mode.0

I'm assuming that the PPC have to pay for the IAS appeal as with POPLA? Is not appealing exactly what the PPC want?

A total ignore by every one would serve to render the service with out any customers , showing it up. And lots of newbies do not realise that they will fail on both appeals and build up false hopes ...... It all so generates lots of forum traffic with people asking how to appeal the second appeal when its refused.

Thanks to all on this forum for the advice and help. I appealed to VCS the 15 sec stationary "parking" and believe it or not they accepted the appeal due to "mitigating circumstances" and cancelled the notice.
They didn't elaborate but they probably refer to the letter I sent to the MD of Doncaster airport Cc'd to the CEO of the local chamber of commerce, whom recently helped them obtain lots of funding. I politely pointed out that this was not an isolated incident and that wider public awareness of such bad practice was in the public interest.0 -

Here's the appeal text based around the great template provided:
Dear Sirs
Re: PCN No. VC04802705
I challenge this 'PCN' as keeper of the car, on these main grounds:
a). The sum is disproportionate, does not represent a genuine pre-estimate of loss, nor is it a core price term.
b) The sum is extravagant and unconscionable and cannot be justified.
c). There is no evidence that you have any interest in the land. I will complain to the landowner about your aggressive ticketing.
d). Your 'Notice' fails to comply with the POFA so there can be no keeper liability.
e). I believe that the signs were not seen/are ambiguous and the predominant purpose is to deter so there is no contract to pay this charge, which is a penalty.
More Detail:
a). The vehicle stopped for ~15 seconds on approaching the car carks to confirm the correct car park location of the pre-paid booking Ref DSA-DW-587289 (receipt attached). To avoid obstruction at the barriers the vehicle briefly pulled to the side of the road into an unused access entrance before continuing to the car park. There was no obstruction and clearly no loss incurred by the PPC.
b). The extravagance of the sum, at £6.66 per second is 34,885 times greater than the rate pre-paid to park in the car park, is clearly not a parking charge and cannot be justified.
e). Prior to the alleged contravention the vehicle had not entered the car park and therefore no agreement to any terms and conditions of use were made. The vehicle briefly stopped on the side the road, on what is to all affect and being used as a public highway. There is no signage in the immediate vicinity to indicate a no stop zone, as evident from the images on the PCN, nor were there any appropriate road markings either double red or even double yellow lines, as evident from the images on the PCN. This lack of clear signage and road markings in the vicinity along with the time frame clearly indicate that this is a penalty not a PCN and bring into question entrapment.
Formal challenge
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 or cancel the charge.
''Drop hands'' offer
The charge is baseless but I realise that you may have nominal postage costs. Equally, I have incurred costs for responding to your junk mail dressed up to mimic a parking ticket. It is clear that my costs and yours, at this point, do not exceed £15 so this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the spurious charge within 35 days and I will not pursue you for my costs.
Breach of CCRs
I hereby give notice of withdrawal from this alleged 'contract' which was never properly offered nor expressly agreed. This 'contract' is cancelled and any obligations now end.
I have written to Steve Gill, Managing Director Doncaster Sheffield Airport Limited, Cc’ing Daniel Fell, Chief Executive Officer at Doncaster Chamber of Commerce to highlight this example of how you are conducting your business which is extremely detrimental to the hard work that they and many others are doing in the development of this airport to support the region.
I have kept proof of submission of this appeal and look forward to your reply.
