  • I have done, but I'm going to write to the Free Press, an open letter to the MD of the airport, the Chamber of Commerce and Peel Holdings, the airport management company.

    Peel Holdings are just as culpable (and just as bad) about JLA Liverpool , and the Peel Centre , Stockport, as well as many other locations too

    Dear airport, your agents recently issued me with a charge notice that you refer to as a fine in the Doncaster free press.
    first of I appreciate you stating clearly that this is indeed a fine.
    As I'm sure you are aware private companies( such as yourselves ) or individuals do not have any authority whatsoever to issue fines or penalties, or any other charge that may be a disguised penalty.

    As a gesture of goodwill I am now giving you two opportunities to resolve this matter, before i consider claiming my costs against you ( peel holdings/the airport) for the actions of your agents
    1: the immediate cancellation of this charge together with an undertaking that you will cease and desist from allowing your agents to issue further unlawful harges on this site
    2: the provision of an alternative dispute resolution service that fully complies with, or eceeds the Alternative Dispute Resolution for consumer disputes ( competent authorities and information ) regulations 2015. I note that your agents, VCS are members of the IPC which offers a service called IAS ( independent Appeals Service) please be aware that the IAS service fails on several counts with regards to compliance with the ADR regulations.

    I've just had a really good idea. The road in question has three roundabouts on it, if I can get enough people who have been stung by VCS on the approach road to give a couple of hours of their time and all turn up at once and snarl up the road by driving up and down at 5mph (would only take maybe 30 ish people?) while letting the local press know of the protest then maybe, just maybe we could bring this fiasco to a head with so much bad publicity they'll see sense.
    I'm not saying allow a free for all on the road but get rid of the cowboys, get either the correct 'no stopping' red lines in place or correct 'no parking/waiting' in place that are accountable to the council parking authorities or police.
    Or has this already been tried elsewhere?

  • Quick update- a month has gone by and nothing! Don't for one minute think they've given in but at least I think they may not bother chasing my brother in law in the Philipines (do they do this a lot?).


    Also, got absolutely ZERO response for a protest at the airport but have noticed someones trying to do the same at Stanstead on the PePIPoo site, too far away for me to support unfortunately.

    Not sure if I'm jumping someones's post, just new to the forum.
    I got a CPN in the summer, notice on the window and after doing some reading it seemed best just to pay, which I did. The lovely some of £61 but now I have had two letters stating they want payment of £100 as I failed to pay
    Two emails later to them and with proof of the payment in form of their excuse for a receipt and my bank statement, here I am again with another letter saying failure to pay will result in a court case.
    What's going on with this company, why aren't they acknoledging the emails or the payments been made
    Any help or advice would be greatly appreciated

    You've learned the hard way that paying just puts you on a 'sucker' list for which they will believe they can come back and scam you for more.

    However you need to start your own thread, not jump on someone else's, otherwise it'll get very confusing in here.

    We'll need to know dates, the parking company involved, and what's been received and sent.

    Well, I was looking forward to bumping my thread on the approaching anniversary to keep the wonderful people who advised me informed as to any (or not) further developments since I (reluctantly) named my brother in law as the driver on that fateful day, (I have seen a couple of posters do this much to the appreciation of the more 'learned' people on here who stated it was nice to get some feedback).


    Alas, I've had to do it early as yet again that lovely bunch at VCS have tried the scare tactics again!


    Yes, along with quite a few others in the last few days (I've already trolled through a couple of threads) have received a letter from VCS stating that due to having failed to make payments....blah blah yawn zzzzz its now in the hands of .........BW Legal !


    Now I need further advice (I'll try put the letters on photobucket when my laptop stops playing up if it's helpful, but I'm not sure they'll be needed).


    Do I ignore? (it looks very much like another debt collecting letter, unsigned and with the usual cack about CCJs etc etc)?
    Or do I send them HooHoo's e mail (see below)

    "Dear BW Legal,

    The debt is denied. The amount charged bears no relation to the parking fee..

    Your debt collection costs of £54 are not appropriate. The amount is also excessive. I refer you to ParkingEye v Somerfield where debt collection costs of £60 were found to probably be a penalty by HHJ Heggarty.

    Complaint
    I wish to raise a formal complaint regarding your letter. Requiring a response within 10 days to a letter before claim is against practice directions, which require a minimum of 14 days.

    Additionally, you are misrepresenting the legal process. A CCJ is not automatically entered following a successful hearing. The losing party has 14 days to make payment and if they do this has no effect on credit or employability.

    Please follow your formal complaints procedure. If I am not happy with your response, I will escalate to the CSE."

    warning them off, bearing in mind......


    A) I never received any form of appeal code following my first contact with VCS


    B) VCS failed to respond to my first appeal within the 28-35 days time slot THEY stipulated in their automated reply to my first contact (it was 68 days when I finally got a proper response, apart from the automatic acknowledgement)

    C) VCS passed my details to ZZPS and stated they would no longer correspond with me at all and all contact should be with ZZPS


    D) Their evil 'twin' Wright Hassell' (was it really them though?) sent me a fake letter ramping up the cost and level of threat (yea, ok, I'm really frightened by fake, unsigned letters).


    E) But finally, following advice on here, I outed my brother in law as the driver to both ZZPS and Wright Hassell (he lives in the Phillipines). I didn't inform VCS as they had already stated that they would no longer correspond with me on this matter, and told ZZPS/Wright Hassell to pass this information back to their client!


    So lovely people, do I ignore (as a debt collectors letter) OR send them HooHoo's e mail warning them off?


    If its the latter I would love to add points A to E in the e mail, and I would also love to tell them that they either send out court papers immediately or next time they send me any of their empty threats I will be taking legal advice about taking them to court for harassment.


    I think I know what the answer is, just need Coupon Mad, Unkomass, HooHoo, RedX , Half way, Manx Red, Ralph-y etc to confirm the best course of action. (Apologies to those I've missed off the list ).
