    The act in this case refers to the fact that 6 years after no payment or WRITTEN acknowledgement of a debt that debt becomes "statute barred".

    The debt doesn't disappear, and any debt collector or the original lender can contact the borrower to ask for repayment, but once you point out the SB part they HAVE to cease any further action or run foul of the regulators. Once SB they cannot take action in court against you for the matter and for most people the SB date will be also around the date the debt falls off the credit file, so pretty much bog all they can do to get the money back other than write or call once to ask for it lol.

    For info to others on this thread once a debt is staute barred it stays that way forever, you cannot restart the clock so to speak once the 6 yr date is hit, so as long as you are sure the date is passed nothing you do can reset things.

    Just for info mortgages have a longer period (was 12 years I think) and some DCA's have been known to try to make up fake payments to push the clock back-when pushed for proof it was made by the debtor they have to cave though.

    I have no news i cashed the cheque as I owed them nothing, although im still awaiting some ppi cliams that have been running since May, anyone know what the normal timescale with halifax/bank of scotland is, i had the famous phone call over two weeks ago.

    First post so be gentle. I have received one of these today and am completely baffled. It dates back to 2004 apparently. What baffles me is that since 2004 I have not only moved eight times, but six of them moves have been overseas in 3 different countries.

    I have basically been off the radar since 2005 and only came back to the UK 12 months ago. Looking at my credit report, as I have had no credit for 8 years, I have the credit rating of Greece.

    To this, either they have gone to extraordinary lengths to track me down or my suspicion heckles are still up.....BTW I paid off all my debts back in 2005 before I jumped ship from HMSGB.

    One last thing. Is it just me, or is it odd that in todays world I question when someone sends me money ?

    I received one of these for £50, account number is wrong and they also say that they credited my account with £50 also, this account does not exist.

    I contacted BOS and they were not sure about this, although, they are looking back at old accounts and giving redress. I was told to take the cheque to HBOS and they should tell me if it is genuine!!.

    The address on the Natwest cheque is wrong too.

    In 2005, we applied a charge of £50.00 to your BANK OF SCOTLAND account ending in **** when we arranged a transfer of your debt from BANK OF SCOTLAND to J&J Collections which we should not have charged you. I'm sorry that we applied these types of transfer charges in the past and this is to let you know that we are committed to putting this right, by refunding the fee and making a compensation payment to you.
    it goes on blah blah A cheque for £135.20 is included below.
    first of all i have NEVER banked with Bank of Scotland ever, neither have i Banked with Natwest.
    I have also moved house since then and got married and changed my name so how it has found its way to me here is a bit on the fishy side, Never heard of J&J Collections either so what Debt they are speaking is a mystery to me. Why would they go out their way to search for me to give me money? Banks never give out money in free will, I smell a Rat down a rancid sewer.
    will stay tuned to see if anyone else has any more info on this.

    Cash it, i have, and then i applied for ppi on the loans and have been offered £12k, happy days.
