    Presumably you have been getting Incapacity Benefit for quite some time, so why shouldn't the OP get some help while he is looking for a new job?

    I'm a relative newcomer to this site and am quite frankly astonished sometimes by the unhelpful comments posted by a very very small minority of users.

    But a very big thank you to majority of posters who are very helpful indeed :D

    I think the tone of peoples post's can be put down to people being told to fraudulently claim incapacity benefit, and various comments about constructive dismissel, when the OP was clearly out of order and admits gross misconduct, and no medical reason not to be working.

    Admittedly the posts aren't actually by the OP, but as a single healthy person, there really isn't any reason to be unemployed for 'many weeks'. Certainly not where i live anyway.

    The above poster had incapacity benefit when they were entitled to it. The OP isnt entitled to JSA by their ruling.

    Off topic, I know, but surely selling out of date bread as in date is a trading standards issue - although I guess that saying anything now would look like sour grapes/revenge unless you have proof.

    Yes it is. Swearing is gross misconduct no matter what the circumstances.

    THankyou for this information, i will go downt the jobcentre and do this tomorrow. Do i still need to fill in the appeals form and the hardship forms also? I'm not sure how the whole sytem works?

    I phoned the job centre up today and they are sending an appeals form. I informed them i would be taking my employer to an industrial tribunal but this did not have any affect.

    THe also emailed the jobcentre to arrange a hardship appointment. Down to £7.90 now :confused:

    To get past your dismissal you will now need to do temporary work for a couple of years, unless you get lucky and some temping job ends up as a permanent job. Get your cv done (you can look on web for advice on cvs) and start trawling the agencies tomorrow. Dress as if you were going to an interview and be very polite, hand over your cv and ask if there are any jobs going. Tell them you are able to start immediately, and then you need to ring them everyday(or even go to the agency) until they come up with a job. If they know you are absolutely determined to work and persistent they will (hopefully) start offering you jobs.

    When the jobs start to be offered don't say the pay is too low or you are going on holiday (even if you are!), as a refusal on a temping job often offends and agencies will only call you if there is absolutely no one else available. Once agencies know you are reliable and hard working they are much keener to offer you the higher paid jobs.

    This is all advice from personal experience! (But I have never been dismissed - yet!)

    OP - you put up with two years of issues and being asked to do unacceptable jobs, while watching nearly everyone else leave. But, did you make a complaint to anyone? Did you visit the CAB? Did you do anything that can now be called upon as evidence that you were provoked????

    If not, then how on earth are you expecting to claim unfair dismissal? Further, how on earth are you going to convince the Jobcentre that you are not just someone who thinks it's ok to tell their boss to p1$$ off?

    If you have some proof then go for it but if you haven't then I'd say stop wasting time trying to fight the inevitable and get another job! It's hard when you have no reference but it will be even harder once you've spent a while on benefits. Act now and get yourself out of the rut you've created for yourself.

    As for claiming incapacity benefit - words fail me!!! :confused: 'Desperate times' call for harder job seeking efforts imo.

    That is my advice - I have not judged you btw (as someone is bound to moan - as always happens when someone points out the true facts as written here :rolleyes: ). Start seeking some evidence if you are hell bent on appealing but do remember you will still have no reference at the end of it so your job seeking 'problem' won't have changed.

    yes some great advice and some right garbage "just get another job " just what he wanted to here really if thats the best you could do why bother saying anything at all how many have you "just get another job "have been in this situation ? none i bet
  • original poster, i feel for you. i would suggest you get down to your nearest citizans advice and talk to them, as you will need some money to live on even if you get a job because of the time it takes to go through interviews, lay weeks ect. i think you can apply for a crisis loan even if you are not waiting on any benefits ect. the phone line is usually always engaged but you get through eventually and the money is paid quickly. although i know you may not want to, do you have any family of friends you could borrow some money off to keep you going? or anything you could sell in your local paper for some fast cash? good luck.
