JSA stopped, no money, no food.. nothing

    Op isn't incapacitated, they are unemployed. The solution is to get a job, not fabricate an illness; that's benefit fraud.

  • Go to your Jobcentre ASAP and complete a JSA10 form to apply for hardship payments. Also put your appeal in. Do not delay.

    There are 2 sides to a story.

    Jobcentre have checked with your employer & accepted what they were told.
    Does not mean it was correct.

    If you think behaviour of employer & as a result Jobcentre are unfair, you must appeal.

    Sounds like you were standing up for yourself, your rights & this could be grounds for constructive dismissal.

    You were being treated badly by your supervisor & being asked to do things which you knew were wrong.

    You challenged instructions from your supervisor which you knew to be unlawful & were summarily dismissed on a trumped up accusation.

    It would not be constructive dismissal (although possibly unfair dismissal), because the OP was dismissed.

    Did you ever put in a grievance at work about the way your manager treated you? If not, why not?

    Well, what you can do is say you be taking your employer to industrial tribunal and claim constructive dismissal
    Job centre would give the form and explain how to proceed plus they should start paying you benefit also.

    I agree with this, there must be grievance procedures within Somerfield, you should have spoken to your Personnel Manager to let them know and they should have been able to help resolve the issues you were facing. If the manager had a grievance(s) against them, they may have been disciplined, it should have been investigated whilst you were there.

    I have no idea about JSA, sorry.

    Humm, One more thing I want to add it does not matter weather you cliam for constructive dismissal is successful or not you would start getting benefiit immediately job done!!

    how ironic that the state always beleives what an employer says happened leaving a claimant to fend for themselves like this person with no money coming in.

    even when the person appeals they take ages to look at the appeal etc etc etc and if at the end it is allowed take ages to pay the money

    you swore at your manager, thats gross misconduct, i would have sacked you too, stop complaining and get another job, or is this in the "benefit scrounger wannabee" section?, i have 3 collapsed discs, one slipped disc, osteoarthritis, i spent the last 3 years hating the benefits system and not being able to do a full time job, ive now designed and started my own business just to get off incap benefit,and your problem is?
