Wow, that's a bit rubbish. I didn't have to argue with them so I wonder if they actually looked at the T&Cs following your call!! I hope you follow up with a complaint. That said, as they'll be unable to highlight the relevant text I wouldn't be surprised if an apology and a goodwill gesture suddenly materialises. Am happy to give you my details if you do complain. It's clearly unfair to deal with similar complaints in different ways.

Got letter today, and my interpretation of the T&Cs quoted is that they refer to payments out not in, sent another e-mail saying that and that i know of another customer who was treated differently so will see what happens.

Oh dear, sounds like they're making a bit of a mess of dealing with this. Ultimately they're going to have to concede that you're right about the T&Cs. Considering the runaround they're giving you I hope you end up getting something nice from them.

Apparently they still think my complaint has been dealt with fairly. Considering I'm getting the interest and won't be making the same mistake again, I'm not entirely sure I can be bothered escalating to the FOS even though I think the wording of the T&Cs is clearly wrong.

Final update in case anyone googles this on the future.

FOS adjudicator agreed that the terms and conditions are confusing, but couldn't find in my favour as they do actually say (hidden deep inside) that only working days count, and I had been awarded the interest so hadn't lost out financially.

FOS can't adjudicate on varied treatment of different customers as they are prevented by the Data Protection Act.

thanks for coming back to let us know how you got on.

At least you know where you stand with the T&C's now going forward and luckily enough you didn't lose any interest.
