Account suspended,automated replies...

Hi

I bought a bulk lot of items from a supplier to a well known mother and baby store.

The items were described on the suppliers site as being excess stock to the (named store) so with the tags removed to prevent anyone trying to return them to (named store).

"Great!" (I thought) - buy in bulk and list individually. Did the sums and they all added up.

Listed the items on eBay, as described by the supplier. Multiple listings, different sizes, buy it now prices.

My account was suspended due to a complaint through eBay VeRO from the said (named store).

The initial standard ebay emails seemed to suggest that I was either selling counterfeit goods (they aren't) or else breaking the rules (set by the trademark owner) about use of their name.

In fact (named store) had provided eBay with a notification that I was not authorised to use their name and so eBay were legally bound to remove my listings - and due to each one being in breach, they suspended my account for 12 months.

Slightly aghast, there was more to come.

My PAYPAL account was suspended too and the standard email from them stated it was because my eBay account had been suspended for selling counterfeit or goods in breach of eBay rules. (I have a sneaky suspicion that the freeze PAYPAL put on my account is unlawful as they are in effect running a bank account...?).

And more.

A few days later my husbands eBay account was suspended too having been "linked" to mine. eBay had identified that we shared some details (we have the same address and telephone number...!) and so that was a breach of the rules too (a suspended member cannot have multiple accounts and they thought we were the same person).

At this point we were feeling pretty low, but...

(Named store) wrote back to us (we had written to them apologising for the breach, explaining what had happened and why) and said they were "happy for our account to be re-instated under the circumstances" - WOOHOO!!!

But no.

Although they told eBay the same, eBay won't reinstate the account (mine, or my husbands) because (named store) have not confirmed it was their error.

(Named store) will not state to eBay that they made an error because this puts a black mark against their VeRO account, and in fairness, it was the supplier that lead to the situation, not (named store), so we understand their position....

We have emailed eBay and got various versions of the same standard email, they have said they believe that the two accounts are run by the same person and asked us to send proof of id (which we have done).

I am distraught.

I had hoped to work from home now I have come to the end of my maternity leave and raise the necessary income from an eBay shop.

Not a hope - eBay won't listen to the (named stores) agreement that my account be re-instated, I have bought a bulk of items I have no outlet for (so am in debt) and my husband gets side-swiped for living with me.:confused:

Can anyone advise?

Ebay Customer Services are pretty much non-existant, it is clear that they do not read the emails you send (I sent a copy of the email from the named store and their reply asked for a copy of the email from the named store...).

I wouldn't do anything knowingly to break the rules, I fell foul for describing the goods exactly as they were described by the vendor and now the impact on me is HUGELY disproportionate to the situation - I am having to change my plan and go out to work, putting my children into childcare.

I am not angry as such, just bemused and upset.

    ebay and paypal are a law to them selves and you have my sympathy. but until a viable auction site arrives with they own payment sevice to rival ebay they ebay will continue to do as they please. I cant wait for someone to topple ebay.

    i also hear that ebay are now starting to make you list in some catagories with paypal as a payment method, wont be long before this is rolled out to ebay entirely. this may hopefully be ebays mistake which wrecks their business

    I got booted off ebay a couple of weeks ago, seems my 98% feeback was to blame. Sales had plummeted over the last year or so so I was not really that bothered.

    What irritated me more was that my wife also got kicked off just for being married to a NARU ebay member.

    Surely this is collective punishment as outlawed by the UN?

    I looked at ebay for the first time for a coupe of weeks, there seemed to be very little listed?

    Is this the start of the end?

    It's not like ebid or tazbar have much on them to provide competition.

    Looking at the boards (which I had never seen before) I find seller 1066sales in exactly the same situation (except not - yet - suspended) - can someone contact them to look here? (I can't because I am not allowed to register...)

    Can I please remind users that are unaware of the value of some advice that to attempt to use ebay whilst suspended is foolish and when you are caught the suspension will be made permanently.

    In the absence of any sort of formal appeals process, or any regulation under UK regulators what other option is there for people who have been unfairly suspended from using ebay?

    The OP appears to have done nothing wrong and worse has invested money and time into a busies which has been unfairly destroyed by the actions of ebay...

    And what of ebays nasty habit of punishing anyone who shares an address with a naru'd member?
