Problem is you fall down a gap in regulation/ombudsman with that.
You can't go to the FOS as mobile accounts are not within their remit, even when with a collector.
ICO - complain perhaps as you can argue that now you have shown it was opened fraudulently, then knowingly continuing to record it on your name on credit records could arguably be a breach of the DPA/principles.
Could even threaten legal action on that basis.
Complain to CRA as sometimes that can help, though most times they pass the buck to the creditor.
Could complain via original creditor who may have something in the purchase/sale agreement to cover such eventualities, that they could enforce on Arrow.
Any/all of those could be an annoying long fight....

THEN, complain to ICO etc? I don't have much time. I need to get my mortgage by end of June, and I don't have a huge problem with paying it as it's not a huge debt0 -
could you give the money to your mother to pay? although they may not accept a payment from her, worth a try
In the letter Mum wrote to them she offered full payment for it. I don't understand, the debt isn't even in my correct name. It's in my birth name, which I've NEVER used for credit in my life.0 -

How old is the default?
You can still get a mortgage with one, preferable to be settled. You may want to post on the mortgage board to see who would be the best lender to approach.:beer:0 -

It was marked default in July 2011 - so almost 4 years. Do you think I should wait until then to apply? I can also settle it for that date. I'm so mad0 -

I highly doubt you will be able to get this sorted within your time-scale unfortunately as the CRA's update monthly at the best of times, sometimes 2-3 months depending on when the companies send them the info and as we are days away from the end of May, if you are lucky your files would be updated at the end of June, if not after.

Yeah, he said that he might still be able to get me a mortgage if it's settled. I think I'll just have to pay it and hope for the best. I am devastated though. I spoke to Debt services managers and they told me what to do.

Even settled the default will still show on your account.

Hi Kat.
Finding that you have been a victim of fraud is always distressing, particularly when a family member is involved.
If you contact the credit reference agency that has the information recorded and explain that the entry is fraudulent, then they will contact the company on your behalf to query the accuracy of the information and mark it disputed while they do so.
You can also add a notice of correction to the entry to explain that you believe the entry was fraudulent, which lenders will have to read before proceeding with a search of your report.
If the company refuse to amend the information, then the next step would be to take the matter to the Office of the Information Commissioner as Fermi has mentioned. They would then be able to instruct the company to remove the information if they agree it does not relate to you.
Our Ask James page goes over having a default on a report when you apply for a mortgage here (in this case on a partners report) and gives some useful tips on what you can do to lessen the impact.
