    Thank you for your advice. I think I'll pay it and contact ICO at the same time.

    I'm surprised they're allowed to have the stance that they don't have to investigate if it's a civil matter though.

    They aren't. It's just the DCA being awkward as they don't want to deal with it.

    What if I write them and tell them to take it off or I'll contact ICO/legal advisers? Should I do that first and give them 7 days? Then I can pay after?

    Could be worth a go Kat and say I will pay this but I want a letter confirming you will remove this from my file with a set period after payment is received, Once you have it in writing then pay them.


    See what they say to this and if they fail to act then say okay tough wait on your money and get it cleared from your name first as per above suggestions.

    To Lowell. No money will be paid on this account unless you recognise that it was taken out fraudulently in my name without my permission, that I am not legally liable for the debt, and that all trace of this account will be removed from my credit files. Should you take legal action in my name I will defend in full informing the court that you were aware that I was not liable and so court action is an abuse of process and vexatious. Should you take legal action in my mothers name that would represent admission of the fraudulent status of the debt and that your credit file reporting has been deliberately and knowingly inaccurate since you were informed. Should you remove all trace of this account from my credit file I will arrange for a settlement by my mother of the account. This will not happen under any other circumstance. Not withstanding the above I shall be reporting your deliberate inaccurate reporting on my credit file and refusal to correct this to the ICO, and reserve the right to seek enforcement of removal and a claim for damages through the courts.

    Or words to that effect. :P

    Honestly I wouldn't pay it, it will look like acknowledging fault. I'd be hitting them hard along the lines that rizla suggests and I would be putting them in contact with your mother.


    Could you ask them to provide the original CCA agreement? That may help you to prove the fraud.

    Come off it.

    The fraudulent debt is a matter between OP's mother and the original creditor.
    The false entry on OP's record is a matter between the original creditor and the DCA for the first part and the OP for the second part.

    Both of these should be put right between the parties concerned and do not requiore any interaction between OP and OP's mother.

    Because I only found out about the debt now when I requested my credit report to get a mortgage?

    Thanks for this. I'm going to send this off tomorrow and ask for a response within 7 days. Worth a shot I guess :)
