Mum used my name to get credit years ago...Arrow Global refuse to investigate fraud >

as it's a civil matter.

They say they won't change the name on the account as "it is legally in the name of xxxx"

Help please, what are my next steps? I've done everything they asked of me. I created a fraud thing online, I asked my Mum to write a letter to them, signed saying she opened the account fraudulently and in my name.

It's taken them 4 weeks to tell me they won't investigate it.

It's a tricky one tbh, I believe you can go down the road of reporting it to the Police and then once they have been involved you may be able to go back to Arrow Global and say to them look here's the paperwork that relates to this now you have 7 days to amend or I will take legal action.

This may make them change them mind and alter it but I feel that being a debt collector they will just ignore you and if push comes to shove it will be both time consuming and expensive to have this removed from your name.

i assume they are chasing a debt, a debt your mother incurred using your name. Easiest & fairest option would be for your mother to pay off the debt.

I'm not even bothered about the money, I'll even pay it. It's on my credit file as a default!! I need this off as I'm applying for a mortgage.

If you found out about it and didn't go to the police at the earliest possible opportunity you've basically accepted the debt as your own.

As soon as I found out I created an ActionFraud report. Which is creating a report with the police I think?

My only issue paying is that I'll be accepting responsibility for it

Problem is you fall down a gap in regulation/ombudsman with that.

You can't go to the FOS as mobile accounts are not within their remit, even when with a collector.

ICO - complain perhaps as you can argue that now you have shown it was opened fraudulently, then knowingly continuing to record it on your name on credit records could arguably be a breach of the DPA/principles.

Could even threaten legal action on that basis.

Complain to CRA as sometimes that can help, though most times they pass the buck to the creditor.

Could complain via original creditor who may have something in the purchase/sale agreement to cover such eventualities, that they could enforce on Arrow.

Any/all of those could be an annoying long fight....
