Is it just me that reads the email from `paul` as a thinly veiled threat that he thinks its Mr Dust dumping the dumped rubbish onto council land , to enable it to get collected?Never, under any circumstances, take a sleeping pill and a laxative on the same night.0

send copy of notices from council to charge you along with copies of all from you advising truth of situation to local paper.I am responsible me, myself and I alone I am not the keeper others thoughts and words.0

Well, I was thinking that, but wanted to see if anyone else picked up on it too without me leading them there... :cool:0 -
ok, folks, here's what I replied with the following day. I'm happy to admit I'm being a little cheeky in places and, with hindsight, would have toned it down a bit. Still, here goes:Dear Mr <snip>
Thank you for your email. Can you please clarify what you're talking about as I think you may be completely misunderstanding the circumstances of the flytipping that's been occurring here. I'll answer the points you make in turn:
>> I understand from your E Mail to Mandy Birch of Swindon Borough Council this morning 03/09/2015 that the
>> waste problem you had on your property has been resolved by persons unknown at this time,
Just to clarify, the rubbish that has been getting abandoned here for yours has *not* been left on my property at all. It's been dumped at the *rear* of my property, on the public lane / alleyway that's pictured in the two photographs you sent.
>> we (The Council) did not clear this waste from your property as I explained to you in my previous e mail we do
>> not remove waste from private properties, but as you can see by the photograph it’s been dumped into
>> the alleyway. Although I now believe this mess has been cleared from the alleyway by our street cleaning team.
So, your street cleaning team *did* remove the mess, from the alleyway, that was *always* in the alleyway. It was never anywhere else and I'm not sure why you think it was anywhere else.
>> The member of the street cleaning team recognised the waste in the alleyway as exactly the same waste that
>> was on your land previously, photographs were taken of this waste before on your property and after
>> found dumped in the alleyway.
Again, you're not making any sense. The mess was *always* in the alleyway and was never anywhere else. How can your street cleaning team member say that it was previously "on my property" before it was "moved". He wouldn't have been able to enter my property to see if anything was there or not.
>> Why any member of the public would go onto private land that doesn’t belong to them and throw someone
>> else’s rubbish out into an alleyway beggars belief.
No one did.
>> I will be doing extensive enquires into this unsightly mess to ascertain exactly who has dumped this rubbish in
>> the alleyway and I will take further enforcement action against those responsible when found.
Good luck with that.
>> Because this waste dumped in the alleyway originated from your property, I would have asked you in the first
>> instance for you to remove it back onto your property and to dispose of legally, fortunately this was taken out
>> of the equation because of our street cleaning team removed the waste .
>> Fly-tipping is a criminal offence and the penalties through the courts are high, I can assure you Mr Whiting that I
>> will be doing my utmost to find out who went onto your land and dumped the rubbish into the alleyway,
>> if you know who has done this please let me know in the strictest of confidence.
To clarify one final time, nobody went onto my land and nobody moved any rubbish from "my property" into the alleyway. It was *always* in the alleyway already.
Regards
Mr Dust
I should also point out that, so far, there's been no sign of the notice that he promised he'd get put up in his first email...0 -
And this was his reply just a few hours later...Hello Mr Dust,
Thank you for this e mail, I will answer a few of the points raised by yourself but I am not going to get into an E Mail stream with you as I am far too busy and this waste problem has been resolved for the time being, I am also mindful that waste dumped on other people’s property like yours is not only unlawful but very annoying for the residents involved, part of my work for the Council involves gathering evidence from fly-tipped areas and prosecuting offenders through the courts, we have been very successful ,we have also successfully gathered evidence from persons reporting fly-tipping only to find out that they are the ones responsible in the first place and thought if they reported it to the Council we would just turn up, remove the waste without any questions asked, I thank you for your good luck message into this investigation.
What I will explain to you is the curtilage at the rear of your property belongs to your house and that is where this waste was placed/fly tipped originally, therefor Mr Dust as I have stated previously the waste on your land then becomes your property and it is your responsibility to legally remove, this is the law of the land and as such we as a Council have to follow the procedures put in place, hence writing to you in the first instance to remove this waste from your property .
And yes our street cleaning team did clear up the waste after it was removed from your property by persons unknown and dumped in the alleyway, the waste was never always in the alleyway as you state in your e mail, although it was visible from this alleyway it was on your property, I felt I just needed to clarify that to you Mr Dust.
My advice to you Mr Dust is still give a thought to fencing your property to deter further waste being dumped on your property and if you do have any evidence where waste dumped on your property originates from then please feel free to contact me and I will certainly take further enforcement action
I hope this clarifies the lawful requirements
Kind Regards
This was a few weeks ago, I've been too busy to respond further but, of course, a whole ton of new junk has been building up again at the rear of my property and I feel another email coming on soon...0 -
I think this is your alleyway
You need to safeguard your property as others have said by erecting fencing, its fairly easy to do
Goggle wont let me go up that land on only side. Yours is on rhs top picture 4 doors up I think0 -

As I said already, if I put a fence up in front of my garage, it's a rather stupid thing to do and I'm not prepared to do it just to protect a few inches of concrete that I'm not even 100% certain that I'm definitely responsible for.
Also, more rubbish appeared last night - one of them being an industrial-sized empty bag of rice...0 -
Can you post a picture of the back so we get a good idea0
-
Will do when I get a chance...0

This is turning into Garagegate.
In fact that would be a good idea. A gate for the area around your garage.0
