Well this one came back to life.

    EUlLAKj.jpg

    The letter stated:

In the recent Supreme Court judgment in ParkingEye v Beavis, the highest court in the land believed the charges to be lawful and commercially justifiable.

You can find the full judgment at https://www.supremecourt.uk/cases/uksc-2015-0116.html

They are now threatening me once again with 14 days or:

"If the payment of the sums owed is not made within 14 days, our Clients' client can instruct us to issue Court proceedings. A Letter Before Action has previously been sent to you, accordingly EXCEL PARKING SERVICES LTD is at liberty to initiate proceedings without further notice.

If the matter were to progress to Court and we were successful in pursuing a claim against you, a County Court judgment would be granted. This could severely affect your credit rating and could impact on your employment. We would of course wish to avoid taking this action and minimise costs incurred in collecting the balance, but this can only be achieved if you engage properly with this matter."
  • I thought I'd heard the last of these scam artists. Can anybody on the forum please advise here - do I actually have reason to be worried, or is this just more scaremongering on behalf of these !!!!!!?

Report this IMMEDIATELY to the SRA as a gross breach of professional conduct, Beavis has NOTHING to do with airport parking.

Allege that they are attempting to obtain monies by deception and complain to both the Police and Trading Standards. Ensure that the SRA and WH are aware of this. Re-read post 15, THEY WILL NOT TAKE YOU TO COURT.
You never know how far you can go until you go too far.

they were for many years a respectable company , however they have now "sold their souls" in order to survive

have since visited Liverpool airport, and have noticed they now have much more visible signs that quite clearly state something along the lines of "You will be fined £100 if you park in this area", but that certainly was not the case when I went through this situation.

    where those the words used?

[QUOTE "If the matter were to progress to Court and we were successful in pursuing a claim against you, a County Court judgment would be granted. This could severely affect your credit rating and could impact on your employment. "[/QUOTE]

Surely, by omitting to say that none of this 'could' happen if the settlement was paid within the stipulated time, makes this 'scare tactic' completely false and misleading. Yet more grounds for a complaint to the SRA. I'm sure that Solicitors are well aware of falsehood and prevarication ??
  • Leamington Spa isn't too far away from me.

I wonder how much fun we could have with them for a £4-ish bus fare? ;)

Similar to my case at Doncaster airport. The advice I've been given is that neither WH nor ZZPS can issue court proceedings, (but that WH letter looks very much like a fake one I got, no signature, telephone number does not match WH number on their website and it looks like something you could throw together with Microsoft Word in about 10 minutes) the original PPC are the only company who can issue court proceedings. They are going to find that difficult as the signage is VCS yet the issuing PPC is Excel!
Looks like a case of the right hand not knowing what the left hand is doing, I wouldn't lose any sleep over this it looks like they've b@llsed this one up more than they usually do.

(would also be interested to know how some posters are managing to post photos when I couldn't and had to put links to Photobucket?)

NOBODY can post photos to MSE. EVERYBODY needs to use a photo hosting site (like Photobucket et al). What you may be confusing is that some people are using IMG tags in their posts so that the photos (hosted elsewhere) are visible on MSE.

It's just a standard debt collector letter with a bit about the Beavis case added. Seen that one loads of times. Ignore it, a standard template with an extra sentence - so what?

    https://forums.moneysavingexpert.com/discussion/comment/64350600#Comment_64350600

It's not a Letter before Claim, WH are acting merely as debt collectors in that letter.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
