Hi all,
well initially I won with MBNA, got back 5200 pound, so thought I would go to Halifax and also Barclays.. both of them have rejected me.
Halifax have said that they my affordability was in order and so didnt affect the card, the premiums or whether I was accepted as it, as ppi wasnt taken out until I rang to activate the card. Barclays have replied with " we have identified that my application for PPI was submitted by post. At the point of applying for PPI, as no advice was given the process required your customer to select the specific type of cover they required"
"we are satisfied that the information presented, accurately described the scope of the policy, and was sufficient to provide them with all of the information necessary"
I had no need for either of these products as I was in 12 months pay of sick etc and therefore any bills would have been covered as normal.
Should I go on to SAR both of them , or just go to the FOS ..? Cheers for all your help...]0 -
I've had a letter confirming MBNA have rejected my complaint and they have forwarded a copy of my application form. It was a paper form and now I see it I can remember that I used to get these personally addressed fliers through the post a lot and I filled one in and got the card. I can see that I have actually ticked for PPI and I have also ticked that I am self-employed.
I've been in telephone contact with MBNA and it turns out that they have not scanned onto the system a copy of a letter from HMRC confirming I have been self-employed since 1990 and they have agreed to reconsider the decision if I send them a copy of the letter, which I have done (their only e-mail address doesn't seem to be working so I've faxed it and I will post it as well).
But my question is: is it a mis-sell as I am self-employed and was at the time or is it not a mis-sell because I ticked the box even though I was self-employed?0 -
My husband received a letter from Nationwide this week Re: Credit Card Protection Complaint, telling him that his Policy was suitable for him at the time of sale. Reasons given -
- "Paperwork provided to you at the time of sale and subsequently, including the Credit Card Insurance Leaflet and Policy Document...We have continued to provide any additional information in order for you to decide whether or not the insurance remains suitable for your circumstances".
- "I have reviewed the suitability of the policy for you based on your personal circumstances at the time of sale"
- "You stated that you had employee benefits which would pay your full salary for six months and then half of your salary for another six months in case of accident, sickness, or you being made redundant. You also advised that you had savings that would help you keep up repayments if you were unable to work. You stated that you would have relied on your savings as an alternative method of making your Credit Card repayments. However, the PPI will pay out regardless of your savings, leaving your savings to maintain additional outgoings. It also might be questionable as to whether your savings would have been best apportioned to Credit Card payments particularly in the case of long term illness or unemployment".
- "Furthermore, you did not have any health problem neither were you registered as disabled at the time of sale which could prevent you from claiming on the policy".
- "The Credit Card PPI would pay 10% of the outstanding Credit Card balance subject to a valid claim, for up to 12 months per claim in the event of accident, sickness or unemployment. The policy would also repay the balance on the Credit Card in the unfortunate event of death, subject to the terms and conditions. This would allow you to use any additional funds received from your employee benefits to meet your other financial needs if you were unable to work".
- You also stated that you have retired since you purchased the policy. I have reviewed our records but can find no evidence of you informing the Society of these changes. As stated in the Policy Document provided, it was your responsibility to do so.

I printed off the template letter approx 2 months ago as I knew I had taken out a loan in the past with Clydesdale, but had absolutely no paperwork. I got a letter through a month later saying they were looking into my 'complaint'??? but it was taken longer than normal. I totally forgot all about it until yesterday when I got home from work - my 'complaint' had been upheld and they were going to pay back the PPI, plus interest, plus compensation - total amount £1864!!!
Apparently even if you send in a letter asking for copies of previous loan agreements and write PPI on the envelope it automatically gets forwarded onto a designated team and they then treat it as a complaint - I didn't even have to ask for anything except the original loan agreement!!0 -
I have received an offer of £1495 from HSBC for a loan and credit card.
The loan amount is £1238 which im happy to accept.
But the credit card is £257 which im unhappy with as the credit card is from 98 until present and still active but HSBC and myself only have statements dating to March 2005 so the claim is from March 2005 to some time in 2007 when HSBC automatically stopped the PPI, which i never knew i had or never knew HSBC added or removed.
I have emailed the CEO of HSBC stating that because they have admitted liability for mis sale then i would like a "reasonable" offer for my credit card redress as the PPI was added by them for 9 years.
Also as either have no more statements in the system or archive, then i have asked as to FOS guidlines that they use the contractual interest they have already worked out and average it over the remaining 7 years thet the PPI was payed.
Am i in my rights to request them to do this or should i just accept the offer?0 -
After my success with MBNA credit cards(just under £9000) i have now had success from Northern Rock Paysafe (NRAM) which had PPI on my mortgage total payment due back £1857, not unhappy with this although felt it should have been more still if i hadnt of called then i would never have received anything.
I also had a reply from Barclaycard saying they needed more time to resolved my cases (3 of them) and i would hear in due course, when i phoned them they put no time on the case and to contact them in a couple of weeks, or go to the the Ombudsman. Not sure what to do here as it could take ages with the Ombudsman or stick with Barclaycard to resolve the matter in due course, anyone else had this problem?0 -
