PPI Reclaiming successes and failures

Hi me again,my daughters PPI NOT UPHELD,received today,The reasons put as follows
During the internet sales process you experienced information about PPI(i enclose a copy of your AAPLICATION FORM)signature being electronic.
PPi appeared on a seperate screen to your credit card applicartion,It would have been clear from this seperate screen that the PPI was a distinct product from the credit card.In addition, you were offered an option to tick the box to purchase PPi.This option to tick the box would have made it clear to you that you could choose whether or not to purchase PPI (Sept 16 2006)Given that you ticked the box,i am satisfied that you actively chose to purchase PPI and you understood it was an optional when you did so.
At the time PPI was added to your account, you were eligble for the cover,(you stated on application that you were a uk resident aged 18 (19 at the time ) and in full time employment,As you have not provided any evidene you had any adequate means of protecting your repayments in the event of pro-longed sickness or unemployment,i have reached the view that, given your circumstances, the PPI policy you purchased provided you with the cover which wuld have been beneficial.I have seen no evidence of anything which would have changed your decision to purchase PPI.On this basis.i regret to advise you, that i am unable to uphold your complaint or issue a refund of the premiums you paid.
We have now exhausted our complaint process, therefore i must inform you that this is our final response and if you remain dis satified you must refer your complaint to the financial Ombudsman.
My daughter is adamant she never tick the PPI option ,nor ever would, altho they have sent a copy of an electronic tick, she can also get proof of she gets paid full pay and half pay from work for quite a number of weeks (six months in all ) and also has we her parents own a business, would have been in a position to help her out, which she put on her application.
Can some-one help us out here ,what do we do from here, how can we prove we did not put that tick n the box.Is it our word against theres,
Regards and thanks
By the way it is mbna (virgin credit card )

Thanks to Di and Trish for your responses I am not alone after all lol!!
I will e-mail the customer care as I tried telephoning on Friday but was on hold for nearly a hour.
Glad to see you agree with me Trish and as from what I am reading here most interest redress payments are higher than the premium refunds, particularly on cards that have been held for long periods! Im sick of being ripped off by lloyds and i dont want to pass over the chance to get the maxium that i am entitled to. Ive undertaken these claims with a view to getting debt free and the more I get them the sooner this will be.
Ive had a successful claim with HFC bank about two years ago and then waited for the outcome of the litigation before persuing all the others.
My husband is also reclaiming ppi from Lloyds TSB credit card (awaiting redress offer) and has had a claim on two loans from MBNA upheld for which we are expecting to be settled by the end of the month (they said within six weeks of their letter).
Would be interested to hear how they explain the mistakes they have made with Trish, doesnt inspire confidence does it?
Rhiannon
Hi Rhiannon,
It certainly does;nt , i am thinking on the same lines as yourself, thinking that my interest redress would probably be as much again as the PPI Payments or possible a bit more especially as i had the ppi for 6 and a half years.
As i have mentioned i have statements for quite lot of months withover £100 per month and 93 and 95 pounds and this has been on going for at least 4 years plus at this amount.
There was an earlier thread looking back where someone did mention getting in touch woth lloyds stating they would not accept any redress without calculations, when all of a sudden they produced another £1300 to be added to the bill, which makes me think, they are trying to swindle some of us,or is it that we pass it on to the Ombudsman to have a review, knowing ful well, they can hang on to the cash a little longer.
I really don't know anymore, although i could do with this cash,i am not going to let these theiving rascals get away with it.
iT WOULD BE INTERESTING TO HEAR IF ANYONE AS BEEN SHORT CHANGED BY LLOYDS,SO FAR/0 -

I think there was someone short changed until they read on here, I'm sure they were offered their ppi charges + 8%, but not the interest charged on the card, circe 18/19% which equated to alot of money, this is why with credit cards, so many people get hung up on this 8% and not the actual card interest.
Look at some over the past couple of days, one person posted either late last night or this morning with £63k and another of £33k and I think there was another one for about £43k as well, thats well over £100k on three people and all credit cards.
This is why myself and other regulars on here urge people to post and we'll do our best to assist, although figures for CC are hard to do very complicated. As I done earlier it can break down to a reasonable figure for the months covered and gives an idea to compare to.Thanks to all the competition posters.0 -

Sorry to bump this up...but I would like clarification.0 -
The 8% simple interest hunnyluvinbear, you only need to declare it for tax purposes if it has been paid gross by the bank, most banks pay it back net so tax has been paid on it. If your not sure phone the bank and ask as you don't want the tax man chasing you laterSuccesses
