    Well I am a soldier's wife and have been getting the emails for about 6 months now. I originally looked at my bank to see if we had any overdraft charges, but the only one we had was for £30 (not our fault) and we had that refunded by our bank straight away! (unusual because we bank with Lloyds TSB!!!)

    After reading this thread, I have written the first letters to TSB, HFC Bank, Capital Bank and Pinnacle Insurance to find out just how much we have paid over the last 6 years in PPI that we have been told was compulsory.

    I have also written (again) to O2 with regards to £422.21 we were overcharged between 2004 and 2005 which was admitted by them but never refunded.

    Hopefully I will get somewhere and be able to pay off one of our two bank loans, which will leave us about £200 better off! (and less likely to go overdrawn lol!).

    I have a funny feeling that we have been charged so much that it may even pay off both of our bank loans which would be around £500 in our pockets and not paying loans, leaving us able to save up to get our car paid off (we still have 4 years left on that!).

    Thanks MSE! You have given me the confidence to take charge of these debts and hopefully be able to save money towards the day hubby leaves the army and we have to try and buy a house of our own!

    Can I have some advice on what to claim under please.
    I have a firstplus loan and it has PPI as a one off up front payment - I tried to cancel this after taking out the loan and was told that I could cancel it - but would not receive a refund (exact date unknown as it was a phone call) - also my agreement is printed/typed - however the PPI boxes are pre ticked in felt pen - the same pen as that of the Firstplus agent that signed off on the loan... As such do I claim misselling and not allowing cancellation?

    I just want to get that money back and off the loan...

    Letter back number 1 - normal fob of response from Bespoke- said they were not regulated at the time and we had all the info etc rubbish.

    I want to start court proceedings this week via small claims as I have done (and won )with my bankcharges so it doesnt frighten me but my question to any readers that may help before I start the process are the following

    1 - Do I issue the summons to Bespoke finance as all the corespondence comes from them?( or is it First Plus)

    2 Does if matter that they are based in Gibralta as its via small claims court?

    Also First plus are 5 days late to their own deadline in repliying to my letter to them with regards to my second loan PPI claim.- I have tried ringing the person on thier direct line all week asking for a progress report and get answerphone everytime!!- should I go straight to FOS with them

    I am in a similar position to you with Bespoke Finance except my loan was with GE Money. I wrote to Bespoke twice and seem to have the same responses that you have.
    I spoke to the FOS yesterday and they are highly annoyed that Bespoke are assuming that my claim is outside the FOS jurisdiction because they state the sale of the PPI was on a non advised basis- they FOS say that it is their opinion that rules not Bespoke's & that they will decide if it was advised or not.
    I'm now thinking that Bespoke are trying to scare me into not contacting the FOS. I'll now thinking of sending the complaint to the FOS to investigate fully before going down the court route- what does anyone else think? confused-smiley-013.gif

    I was just wondering what the average time it is taking for the ombudsman to sort out complaints? The leaflet says 6-9mths but i notice on the forum some people are claiming it is only taking a few weeks?

  • I have had 2 loans in the last six years, with one I feel I was mis-sold protection, the other, I don't even know if I had protection - but think I did! Stupidly, now both are paid off, when I moved I shredded all the documentation, so I have nothing (including reference or account numbers etc...). Should I write to both companies to get the details, and if so, is there a template letter or can anyone tell me what I need, eg. statements, original agreement, terms and conditions etc...

    Any help would be appreciated!

    PS - do I have to include any money for this info to be sent to me?

    they said they are listening to calls

    and repsonse is in 20 days from letter, but my letter asks for response in 14 days??? where does that leave me?

    Hi, I've been trying to reclaim PPI back from a loan with Black Horse, have sent the 2 template letters. Have received letter back, stating that I have no evidence to support my claim & they are unable to uphold my claim. They also state that although they are now subject to the Financial Ombudsman Service, this was only from 14/01/05, so any policy entered into before this date will not be looked at by the FOS. Unfortunately I took out my loan with them on 3/12/04:( !

    Not sure what I will do now!

    Sorry, this is not peace of mind, but hopefully you will have entered into your agreement with them after 14/01/05.

  • Did anything ever get decided about ways to tackle companies who say there is nothing that can be done as they weren't with the FOS at the time of the loan agreement? I remember seeing somewhere that someone had been told by Black Horse Finance that there was no chance of them reclaiming their PPI due to this reason - I just wonered whether the situation had progressed?!? I wrote to Black Horse on 26/10 and have still heard nothing.

    Hello all, I too wrote a letter to Blackhorse and was told Get l**t. So I wrote to FOS and recieved a letter back saying Blackhorse wasnt members of the FOS untill jan 14th 2007 so they can't look at complaint cos I took loan out may 2003. So what I have done is wrote a second letter to Blackhorse saying I hope we can sort it out between us otherwise ill see them in court.
    Ill just see if that helps, not holding my breath though:confused:

    If anyone can help all us that are stuck with Blckhorse ppi all advice will be very greatfull.
