    Seeking some advice re.ppi on an Egg loan. Sent off first letter claiming mis-sold ppi (felt pressured by salesperson and didn't realise it was optional). Had a reply yesterday saying that because it has taken longer than 8 weeks I could go to the Ombudsman. they explained the delay was because they were having problems locating the telephone recording of my application. They say that if I do not want to allow them more time I could approach the Ombudsman. My initial reaction is to go to the FOS as I feel they have had plenty of time. Should I send off second letter saying I am not happy and give them 2 weeks or go straight to FOS?
  • Hi, hope i am at the right place. I have started with first letter as per Martins article with First Plus, I sent it in October and they replied telling me they are looking into details but will reply no later than 8th November. They did reply, recvd 6th November and told me they are still looking into details but will reply by 8th December. Is this OK and how long can they keep giving me letters wanting another month to look into details. It cant be that hard for a firm to look back on records surely? Any help or guidance would be appreciated Thankyou

    They have got much better lately, and they may well be dealing with the bank concerned to try and get you an offer.

    Of 2 complaints i sent in august, one has been paid in full, and another was rejected by bank, so FOS is to give them one more chance to reconsider, before rulung itself.

    They will get to you, but they do have to then prove it was mis-selling. You should know soon, if the bank has backed down, or if its going higher.

    I was very critical of their delays, but considering the amount of complaints, i do think they are going as fast as they can now.

    Im new to this and i will keep this as brief as possible so bear with me.
    I sent the 1st template letter to yes car credit to claim back approx £4000 back from PPI payments as at the point of sale they made it quite clear that we had to have it to get the credit. this happened on 2 occassions that we got a car from them.

    this is what they said in the letter we received

    You have no proof of the alleged conversations that we say took place (needing th ePPI to get the credit), we have only now decided to claim after several years and luckily not needing to make a claim, they say it did cover hubby even though he was self employed which they also sent and highlighted the origanal contract (it does say you had to work over 16 hrs a week, some weeks he did and some weeks he didnt so would that invalidate the claim?) they consider our argument for a refund wholly without merit,they have no reason to believe that standard procedures were not followed. the conditional sale agreement allows customers to voluntary terminate the agreement which we did 18 mths ago. however no such facilty exists with a fixed sum agreement so the insurance part remained outstanding, which was pointed out by them on the termination of the agreement. they said it is our perogative to take whatever action we feel neccessary if we still feel a pursuit of a "claim" is warranted. we have responded to your corresspondence and will now close you file. however , please take note that these agreements with our company started on 28th June 2001 and Feb 2004 and therefore, occured before we were FSA authorised. it is our understanding that this therefore falls outside the juristiction of the Financial Ombudsman Service.

    There were other bits and pieces to do with the contract and the fact that we signed it but thats it in a nutshell.

    SO PLEASE HELP ME! I FEEL BACKED INTO A CORNER. THE LETTER IS INTIMIDATING SAYING THEY ARE RIGHT AND WE DONT STAND A CHANCE. I KNOW THEY SAID WE HAD TO HAVE THE PPI IN OREDR TO GET THE CREDIT FOR THE CAR AND AT THE TIME WE WERE SO DESPERATE FOR A RELIABLE CAR AND I THINK THEY KNEW THAT. AFTER ALL YOU WOULD ONLY GO TO YES CAR CREDIT IF YOU HAD NO OTHER OPTION. ALSO IF I HAVE NO PROOF THAT THIS CONVERSATION TOOK PLACE THEY ALSO HAVE NO PROOF THAT IT DIDNT. DOES IT MATTER THAT THEY WERE NOT FSA AUTHOURISED AT THE TIME?
    I WANT TO DO THS RIGHT AND PLAY THEM AT THEIR OWN GAME. WHAT CAN I DO NEXT?

  • Hello just wondering if there is anyone out there who is reclaiming PPI from a loan (natwest) but is on a DMP?

    I have sent a 2nd letter 'treatening FO' and waiting for reply but just wondered what is likely to happen the loan was for £25k and I have been paying PPI on it for about 2 and a half years although my DMP started in July.

    Any information I would be very greatful :beer:
  • haaving the same problem with yes car credit. they also said to me after i sent 1st template letter that they were not FSA authorised so it is out of the juristiction of the finacial ombudsman service so basicaly i dont stand a chance. if i hear from anyone else with any advice i will let you know

    Hi ds100, thank you very much for replying. In original letter to Barclays we explained that my daughter was told she would not be accepted for the loan without the PPI, which is the one added to the loan amount.
    This was confirmed by a later visit to the adviser.

    Is this the correct grounds do you think? Your help is appreciated MM
  • can someone tell me pls i had a barclaycard that i applied for abour 8- 9 years ago whilst i was unemployed/housewife, ipaid regularly and also protection insurance every time my husband got a wage rise even though card was in my name my credit was increased when we started to feel the pinch i rang barclay card to see if i could claim ppi as i wasnt working and was told that it would only pay out on ppi if i died. Now at the age of 26 i would never have taken out ppi on awys presumed that it was for unemployment. wgat i would like to know is can i claim for this reason and far back can i claim is it the same as bank charges which is 6 years also i am still paying of card at 5.00 per month on payment plan.. pls help anyone

    I had PIP refunded but it was just taken of my loan balance! Is this correct or should they have sent refund to me! This was with Household bank.

    thats correct in base of wot i read here thats the correct grounds for you to claim the money back .... "your salesperson stated / implied that taking out the policy was essential for me to get the associated loan. " so now is time for you to send the second letter and see wot they said they are just playing hard ball with u!!!! good luck
