    Guys,

If anyone has gone to FOS can you please update the Fos time scales thread that I have started.

Lots of questions have been asked about how long it takes, so if you could all record it there, it would give everyone more of an idea what kind of time frames we are looking at!!!

Hope this will be of use to people!!

  • Hi

Can someone give me some advice regarding reclaiming my PPI? I took out a loan ith Abbey whilst i was an employee with Abbey. I was led to believe that it was for piece of mind rather than anything else! I have recently paid off the loan in full including the insurance policy early?

can anyone tell me whether i would have case for a refund?

    Thank you in advance

If you know the name of the Lenders Involved you can submit a Subject Access Request under the Data Protection Act to obtain all the Information that you will require.

    Good Luck
    Ian

How do i submit a subject access request , do i need to complete a form (if so, who can supply it). Or do i just need to write a letter ?

Also, my loans over the last few have been consolidation loans which usually have the PPI refunded and then resold on the new loan. How i calculate what i am owed ? can anyone help !

Firstly, it shouldnt affect your credit score. Secondly these people are lenders, therefore, would rip your arm off to give you more money and charge you interest on it!! Just make sure theres no PPI this time!! ;-)

It won't hurt to ask them, so I will.:p

    Loan = 27500
    Interest Rate 7.7%
    No. of Payments = 264
    Start Date = 20/08/06
    Settled Date =01/02/08
    Settlement Figure = 31372.04
    Payments Made = 4155.16
    Total Paid out = 35527.20

Length of Time you had loan = 18 months approx
Loan plus interest for 18 months = 30757.77

SO In reality the Loan would have cost you 30757.77 if no PPI was involved
and you had paid by this time 35527.20 making a difference of £4769.32. Now if you are stating that you were mis sold PPI then the case falls under disproportional rebate as highlighted earlier in this thread. If you go after the PPI and the fact that the settlement figure was disproportionate (I think if you check the OFT/FOS website's they will tell you more about it) you should be intitled to approximately the above figure.

Hi thanks for working some figures out for me. Now I am unsure which template letter to use as I have said before my initial complaint was via the telephone, but since that complaint I have now settled the loan. Shall I use the first letter and see what First Plus offer or should I quote the figure you have kindly worked out for me and should I quote any Acts. Any wording advice would be very helpful indeed as I am rubbish at composing letters.
I have seen some very good letters on this forum that people have sent, quoting this and that and they seem to get the message across, I am one of those people that go all around the bushes and ramble on (like now).

Even though I have settled can I still claim for being mis-sold, because I have read their T/C's and it says I will not be entitled to any refunds, if you settle before the first five years. Can you tell which page and post number for the Disproportional posts, would like to read them. Will have a look at OFT/FOS website as well. Thanks again:confused:

Firstly I have been successful on reclaiming Total Cover payment protection from Catalogue copany vertbaudet (they are owned by Redcats I believe!) I claimed for £104 inclusive of 8% statutory interest and today have received a letter saying they will refund me £112 inclusive of statutory interest which is fantastic - only after first initial letter.:T

Then it goes down hill I'm afraid. Am claiming in total £182.31 from Marbles and £275 from HFC - today I have received letters back saying that the PPI on these two were approved by myself when they sent the welcome packs and that I had 30 days to cancel if I did not want it. However I have checked and I can not find these so called welcome packs. So am confused - should I still send off letter number 2? I am angry that they are using this 30 day period as a way out of settling PPI claims.

    Anyone able to offer advice?

Also Capital One have done the greatest...I requested reclaim of £978 on PPI for the last 5 years which I did not authorise for and instead their letter today simply says they have cancelled the ppi - totally non mentioning the reclaim amount - boy I am going to get them back for that one...am angry they have just cancelled the policy with no further mention on the reclaim settlement.

Will keep you all up dated.
i've had no success with vertbaudet...letters are going back and forth....basically they are saying because i was missold in dec 2004 the financial ombudsman has no authority before jan 2005

what date did u take the cover from?
maybe you may be able to help me....

i've paid loads over the years

    thanks
  • I used the template on the website for reclaiming PPI from sky credit card. The reason I gave was I wasn't aware that I was paying for this. They have written back saying it isn't a PPI but a payment Break Plan and this is not an insurance product and is not registered as an insurance therefore not governed by any insurance regulations. Please help-it sounds like a PPi to me

  •:confused: I hope u can help...I have put in my complaint for ppi on 4th january 2008 and have recieved numerous letters telling me to hold on for a further two weeks i am now getting fed up after calling them i was told to just wait and they couldnt comment on my individual complaint... so i have decided to follow others mser's and send a further letter, BUT i have become a little stuck!!!!

My loan with natwest taken out on 1 april 2003 and closed on September 2005 ( I repayed early ...it was a 6o month loan originally)

I have the loan agreement details as follows
    Original sum borrowed: £10,000,00
    PPI Premium: £2,458.000
    Charge for credit: £3,238.00
    Monthly Repayment: £261.61
    Term : 60 MTHS
    Total amount Payable £15,696.00
    Interest Rate: 9.49%

Now my question is what figures do i put in this section of the template provided , i have filled in as much as i can but am not sure how i calculate the red totals... I am TOTALLY CONFUSED.. CAN YOU PLEASE HELP ME FIGURE THESE OUT AS I DO NOT WANT TO GET THESE WRONG.
    "
The original premium was £2,458.00 added to the loan amount on the 1st April 2003. I am aware according to the loan details you have sent me that interest at 9.49% was added to this amount . Interest £xxxxx Total amount £xxxxxx. The Statutory 8% interest (S69 of the County Court Act) allowed by the Courts will amount to £xxxxxx. Making the total amount payable at the Court Stage £xxxxxx.

I appreciate any help you can give! THanks in advance
