Both complaints with FOS
we have now been passed to their casework support area to await allocation to an investigation team.
FOS have said they can take upto 6 months to fnalise any complaint.
has anyone been through this and did it take that long for FOS to come to a decision good or bad outcome.
Any info would be helpful
still trying to be positive and hopeful

Hi Laini, we're at the same stage as you but with mbna and ge money, it seems they're inundated with complaints, it's just a waiting game l think.We're trying to reclaim our much needed cash and OH went to do extra work this evening and got his truck clamped!! £120 release fee if you please, it's one step forward and twenty back!!!0 -

We Got a reply to say we werent missold PPI so its another one going to the FOS
Just saw on the success thread that it can take a couple of weeks for the FOS to make a decision , maybe they were lucky so I am hopeful it wont take until August 2008 for ours

Yes l do get those days and then l get angry that l and lots of you have been being ripped off for far too long and l have a little break,maybe a day or two and then get back into it again. Also l've had one success of some charges which spurred me on,so just hang on in there x0 -

No. of Payments 264 months (Loan Period) but only made 17 payments
Start of Loan 20th August, 2006
Final Payment Date 1st February, 2008
Settlement Figure £31,372.04
Total amount payable under the agreement £72,358.27
Less rebate on early settlement (which included
£1,054.72 insurance policy rebate £40,825.72
This is to do with the Consumer Credit (Rebate on Early Settlement) regulations 1983 the "Rule of 78"

Act now that I have settled, but I also think I was misold as well, after listening to the recording of the conversation from the rather pushy salesperson (Lee Evans) I wish I could somehow put it on here just so people could hear how they catch you in their net.
Also in a letter I requested for the breakdown of the settlement, they go on about another Act Consumer Credit (Early Settlement) Regulations 2004 These regulations were introduced under the Consumer Credit Act 1974 to protect customers. How Acts do they want to quote, that is 3 already.
My monthly payments:
Sept/Oct/Nov/Dec 2006 4 payments at £254.94
Jan/Feb 2007 2 payments at £264.62
mar/Apr 2007 2 payments at £270.67
May/JuneJuly 3 payments at £280.10
Aug/Sept/Oct/Nov/
Dec/Jan 2008 6 payments at 285.84
These payments included the monthly PPI payment. Now this is the bit that confuses me, did the PPI payments stay the same (42.37) or everytime the interest rate went up, did the monthly PPI payment go up as well.
So what do I claim for £5480.75 minus the rebate of £1,054.72 plus this 8% thing, plus all the monthly payments I have made (17 @ £42.37) so far,

Can't remember what else I put in last nights post Oh yes just remembered Letters. Have noticed on the Forum people being advise what to put in their letters, I have printed some off already, think I am going to quote the Mis. Act. Does Martin have any templates quoting thisAct or is it best to do your own thing. I will be on the second letter, as my initial complaint was via someone at First Plus sending an E-mail on my behalf to the complaints Dept, so this one will be asking for a certain amount of PPI back, is that right.
Anyway, I hope you can now help with the figures I have provided and it is not so confusing for you, because I certainly do not know what figures I am suppose to be working out, even after reading several posts on here.
Probably rambled on too much, but, I think I have covered everything.
Thanks for your time, especially as you have a new baby in the house, hope you are not missing out too much, these early months/weeks are special.

first plus confirmed cheque in the post should recieve tomorrow, as you know they decided to pay up the whole of the policy :j :j But i believe it has nothing to do with the ombudsnman form its because I EMAILED THE MANAGING DIRECTOR..:eek: I told him exactly how his customer care team had dealt with my complaint and that the tactics used were appauling i felt bullied in accepting the rebate and was told in no uncertain terms that if i took the rebate i couldnt persue my complaint.....:mad: ...
Obviously I didnt get an answer so a week later I EMAILED AGAIN saying i was still waiting for a response from him 2 MIN later the phone rang offerring the full refund and a email from the MD saying he had asked his team to look in to it the day it was recieved obviously they hadnt but i would have a response by the end of the day!!!!! and I DID :T
I never thought id get a response but it certainly worked for me........

I like this, can I have the E mail address just incase I don't get very far with my claim and what did you say in your e mail? How long from start to finsh did it take to claim your policy back. My policy is for £5,480.75 plus 17 payments I have made at £42.37 did you claim for those as well Plus this 8% thingWhile I was typing this we have just had a very large earth tremor, thought the house was going to fall down, biggest earth tremor I have felt here, quite nerve racking anyway I diverse.

Ok - I had no idea about this one. What do you think my chances are
5 years ago I had a bank loan with full PP against loss of work, sickness etc - it only had a couple of years left. During the year prior to this point, I had been back and forth to the Doctor [not excessively, but maybe 4 or 5 times] with tummy pain. I was taken into hospital for exploritory surgery and all was found to be ok. The pain went after this and about 6 months later I wanted to extend my loan. The bank arranged this and the loan was set up as a new loan - again with full PP. About 8 months after this, the pain returned and the Doc sent me back to hospital after I had some major bleeding. As it turned out, I had to have a major operation and as a result I had to leave work for a while. I contacted my PP firm and they refused to pay out claiming that the illness was pre-existing from 18 months ago - even though I had been given the all clear before taking out the loan. I argued that the two periods of illness may not even be realted, but they refused point blank. I had to take out something called a managed loan to pay off my bank loan and after paying 120 pounds a month for 18 months, only 200 pounds came off my balance - I had to borrow to get rid of that loan as it was crippling me. Five years down the line, I still have a loan, trying to get rid of the backthrash of this. Can I make a claim against the PP firm.0 -

Had a letter from First Plus stating that the loan and PP was sold to us by Norton Finance and they have sent our complaint to their complaints team, they are keeping the complaint file open for 8 weeks after which they will consider the complaint as closed.
What do i do now?

Ok first of all ask yourself the question do you think they are telling the truth. All of a sudden they never sold you the loan and PPI. Get them to confirm this in writing with the name of the person whom they have contacted at Norton Finance whom has confirmed that they have sold the loan and PPI until this happens still go after first plus as they may trying to send you barking up the wrong tree.0
