It depends on how fast they attempt to get it set aside. Either way the warrant has been served so am just waiting for the results. As for the 14 days you have to give them the mandatory 40 days to respond, its only fair as then they can't say you haven't given them due notice.
okie dokie, but do l only give them 14 days after the first request for the actual refund or is that 40 days too?0 -
Just been looking at husbands cc. He took out a flexible loan from household bank branch unfortunately was sold PPI which seems to be £40 per month from jan 2005 - nov 2006 23 months worth. the PPI is 0.79 percent he was not told it was optional or that he could go elsewhere at a better rate.
The statements are from Beneficial finance yet also get letters from HFC i guess they are all one and the same! ?
Do you think a claim is in order?? if so who do i claim from or is it straight to HFC (havnt they been fined already?)
Also found obscene amount of charges can we try to get these back
eg 20 for over limit
40 for default
but we do not have all statements to calculate them all as my husband hid alot of them!!!
Can any one remind me of how to get these?

Hi received today a letter from EGG about our PPI mis-selling dated 7th saying they are still looking for recording of calls. Another letter received last week said that they were unable to trace call and PPI was not mis-sold, does this mean one dept has slow mail or do they not talk to each other. Too late all correspondence now with ombudsman see what happens next.0
-
first plus confirmed cheque in the post should recieve tomorrow, as you know they decided to pay up the whole of the policy :j :j But i believe it has nothing to do with the ombudsnman form its because I EMAILED THE MANAGING DIRECTOR.. I told him exactly how his customer care team had dealt with my complaint and that the tactics used were appauling i felt bullied in accepting the rebate and was told in no uncertain terms that if i took the rebate i couldnt persue my complaint..... ...
Obviously I didnt get an answer so a week later I EMAILED AGAIN saying i was still waiting for a response from him 2 MIN later the phone rang offerring the full refund and a email from the MD saying he had asked his team to look in to it the day it was recieved obviously they hadnt but i would have a response by the end of the day!!!!! and I DID :T
I never thought id get a response but it certainly worked for me........
never give up so all the FIRSTPLUS posters you know what to do..................!!!!!!! :shhh:;)
OMG where did you get his email address, what exactly did you say??:rotfl:0 -

Hi
I just recently had this with DFS, my finance was arranged through Blackhorse so I wrote to them regarding my ppi payments, they wrote back and referred me back to DFS who called me then advised I needed to re do a whole new credit agreement, (I have put a couple of posts up) anyway paid of the account in full, called FSA they told me not to resign new agreement and this was not what they say (even though dfs told me it was) long and the short of it DFS are paying me back the money have not received the cheque yet but as its their salesmen ripping people off its their responsibility and the guy at DFS hasn't apparently seen any of my paperwork they are just going to pay me back...
Try head office DFS you never know they might just pay you back
I originally sent letter to Poole branch where we ordered sofas, salesman rang me the next day and was rather rude so I told him I did not want to speak to him and he had to reply in writing. Had letter back saying push off.
Second letter sent to head office, another sod off  . Because so much time has passed (2000 til 2003) they are trying to fob me off.
Been working on 3 x ppi reclaims, 4 x credit card charge reclaims, submitted bank charge reclaim and rejigged all my personal finances so DFS been on back burner!
May send one more letter and ask for T&C as I am planning action, see what they say.PPI Reclaimed -

DaisyBella wrote: »I am in a similar boat to you with DFS/NOVA. My lounge suite bought in Dec 2000. I wrote 2 letters to Nova with no response. I then realised (duh) that I should be writing to DFS as they are the ones who completed the credit agreement. Fortunately I had a copy of the agreement - and surprise surprise, although I had signed the form (which does show amounts) - the section that has PPI (optional) and then a blurb which ends with 'tick this box if you want it' - well that box is not ticked. Therefore it was never explained to me the amount was just automatically added by the sales assistant. This was also my first ever credit application (other than my mobile phone contract) and so I was none the wiser. Anyway, I then wrote to DFS and enclosed copy of credit agreement. They phoned last Friday to say NO. You paid it off years ago, too late, and they don't keep records that long blah blah blah. I mentioned that as I had a copy of the credit agreement - I didn't need their records and the PPI box is not ticked. DFS said - NO and this is their final response. I said 'fine' - please send in writhing - which they did. They cleverly word the letter to say you can contact FOS but very old but maybe in exceptional circumstances blah blah. So I figure today (it is payday) - I am going begin a claim via MCOL. DFS know that FOS can't help me and I know that too - so I figure filing with MCOL may scare them into action. I will let you know what happens (fyi my amount is about £330, but when you add on the interest of 8% it looks a lot better). Also - if you like, I probably have the PPI details at home - and as we bought round about the same time and were both financed by NOVA they were probably applicable to you too???? I will have a look and let you know if that would be of any use??
I did come across something that may be of help to you where the OFT forced them to change their PPI contract wording in 2002 due to Unfair Contract Terms. Maybe another small piece of ammunition!

Both complaints with FOS
we have now been passed to their casework support area to await allocation to an investigation team.
FOS have said they can take upto 6 months to fnalise any complaint.
has anyone been through this and did it take that long for FOS to come to a decision good or bad outcome.
Any info would be helpful
still trying to be positive and hopeful
cheers
