It depends on the letters. Did they say in final settlement to the loan ##### and did you send a reply. If you never sent a reply you can reclaim.

Thanks for that info, I don't remember the wording of the letters, I don't think they mentioned "final settlement" and no I didn't reply to any letters.

There's your answer then don't let them stress you out. There's an old saying:

Be polite but firm at all times and you'll be surprised how stressed they'll get.0 -
Don't bother emailing always send registered mail. It gets there and they can't say its got lost. Same with email's.
This is such good advice, l've sent all of my requests via recorded delivery except one which got muddled up with ordinary post, this being to MBNA requesting charges list, was just about to chase it up as well over 40 days but just realised they have'nt cashed the cheque so will obviously pretend they never got it, so lesson learned and will begin again.....bum!!0 -
Ok i'll stop you there don't phone them as you will be wasting your breath. Send letters and that way you have a paper trail. Any admission's agreements are then documented. If you receive a phone call state that you want it in writing and all correspondance to be in writing. Don't get involved in a long drawn out conversation with them. Unless of course your just !!!!ed off and want a go at someone then its a laugh:D
Hehe thanks! my problem is that i have a shortfall on my house by the amount of PPI (didn't realise it was added onto the loan) and their letter is basically saying ring and talk before going any further if your're not happy with our response, our house sale will probably complete in about 3 weeks so the quicker i can wrangle out even a part settlement from them the better. I'll see if hubby fancies his chances of phoning when he gets in but might just have to wait and see then.

I could really use a bit of advice. One PPI I am trying to reclaim is from DFS. I bought sofas in 2000 and finished paying in 2003. Done all the letters and sent forms to FOS. FOS tells me DFS were not regulated by them at that time (cant find out who they were regulated by). I want to take them to court and although I have the original paperwork, I do not have T&C. The amount is only £240 and it was a long time ago but it is my money and I cannot believe I have been conned out of it so really want to fight to get it back!!!!
I am a partner in a business with staff so have an income whether I go to work or not and would never have opted for PPI as payment was only £46 per month so was unaware of having it.
Sorry it is so long winded, but does anyone have an opinion on whether taking DFS to court would have a prospect of success?

I just recently had this with DFS, my finance was arranged through Blackhorse so I wrote to them regarding my ppi payments, they wrote back and referred me back to DFS who called me then advised I needed to re do a whole new credit agreement, (I have put a couple of posts up) anyway paid of the account in full, called FSA they told me not to resign new agreement and this was not what they say (even though dfs told me it was) long and the short of it DFS are paying me back the money have not received the cheque yet but as its their salesmen ripping people off its their responsibility and the guy at DFS hasn't apparently seen any of my paperwork they are just going to pay me back...
Try head office DFS you never know they might just pay you back0 -
My ppi claim to GE Money on store card is with fos, l have afeeling their reply will be "sorry cant help as they were'nt covered etc" SO was wondering if when l get my reqested statements back for the same store card could l add up the ppi payments from them and claim as you would with charges, if you understand what l mean!0

Hi i thought i'd give an update on my PPI case with Halifax
Initial request August 2007 for information
Fobbed off finally sent to FOS November 2007
All requests for information about by case from FOS was ignored
Took them to MCOL 16th January 2008
Acknowledged my claim 28th January
Filled Judgement on 20th February Against Halifax
Phoned them on 22nd to let them know and ask if they changed their mind
Phoned them on 25th hand been passed to Litigation department
They have decided to fight lol. Have served the warrant on the 25th
Today phoned FOS got them to send a letter to myself reference the three months with the FOS where nothing was received from the Halifax. Phoned the litigation department to let them know and sent all documentation 30 pages of it to the Bulk Centre of MCOL.:D

That halifax thing sounds scarey,l suppose thats what they bank on, the fact that people are to scared to take it all the way, but really well done you, mind you if it was'nt for people like you l would'nt have got this far so thanks.

It depends on how fast they attempt to get it set aside. Either way the warrant has been served so am just waiting for the results. As for the 14 days you have to give them the mandatory 40 days to respond, its only fair as then they can't say you haven't given them due notice.0
