    What next? I took out a professional Studies Loan with LLoyds TSB back in 1997. The loan was repayed in full in about 2005. I took out payment protection at the same time as the loan. At the time I assumed it would cover the full term of the loan but this website suggests that it may only have lasted for 5 years. Even if that worst case scenario were true then my policy would have ended 5 and a half years ago. I have written to Lloyds TSB and they are unable to find the Terms and Conditions relating to my policy. Apparently they sold this aspect of their business some time ago. I therefore cannot prove that I was missold the policy (I am sure it contained an unemployment clause). Does anybody know if I can now claim "by default?" The website says that the banks should keep records for 6years after the policy ends. Is this a statutory requirement? Im not really sure what my next step should be so any ideas would be most appreciated.
    Its not so much that you can not prove that this was mis-sold its more that they can not prove it wasn,t.............

    It would seem that firstplus are quick to credit your loans with a refund even though you haven't accepted, but when it actually comes to sending out a personal cheque refund they drag their feet!
    I posted my acceptance form 1st class recorded on wed 6th feb & haven't heard a peep from them(although their 'sod off' letters always arrived promptly!). Granted, it's only been 10 days & even if they didn't receive my form till fri (suppose 1st class not always reliable), that still leaves 7 working days to wash their hands of me! You'd think that they would be only too pleased to only have to pay out less than half the original claim!
    Oh well, i'll give them another week then put it in the hands of the FOS with my ORIGINAL complaint as they haven't honoured their offer!:rolleyes:

    Picture financial mis-sold PPI
    Hi everyone not been on for a while have now recieved response from Picture with regards to our mis-sold PPi. Just to recap my husband and I tooke PPi in March last year at a cost of £22000, anyway I have fallen ill and am unable to return to work in my present job. Because of my illness and worries about how we are going to keep hold of our home, our loan is secured on our home, I am now suffering from major depression and have been prescribed tablets as I am quite suicidal at times. I contacted our loan company for a claim form and was told I could not claim for sickness through our PPi as I was not covered for this, only death. I then looked on this website and as we were mis-sold the policy wrote a letter, with the help of Martins template and advice from Tiggrae, to Picture. we have recieved a reply today. Basically telling us to get stuffed as It was my fault and I agreed to the policy.
    This is their reply to my complaint:

    Dear Mr Mrs Pickup
    Thank you for your recent letter with regards to the Picture payment Protector (PPP) insurance policy on your loan. I am sorry to hear that you are not completely satisfied with the level of service you have received from Picture. however, after having conducted a full investigation we do not believe your insurance was mis-sold. The concerns you have raised are outlined below

    You were led to believe that both parties would be equally covered on the insurance policy
    We are in breach of the Sex Discrimination Act 1975 by automaticlly naming the female customer as second maned applicant on the insurance policy

    A full case review has been completed by the compliance department in order to answer your concerns and bring this matter to a close.

    On review of this investigation I can now confirm that your loan consultant discussed the policy in great detail with both parties. The loan consultant explained that both parties would receive life cover but only one would recieve the additional Accident, sickness and unemployment cover. You were also advised that it is entirely up to youwho was named as the first applicant on the insurance policy. It was advised that youchoose the highest wage earner to which Mrs Pickup advised 'Yeah well do that then I think, he does earn more than me'

    The loan consultant did not automatically add Mr Pickup as the main PPP applicant infact Mrs Pickup chose Mr Pickup to recieve the full cover. It was also disclosed that Mrs Pickup suffers from food allergies which can be life threatening this was added as a pre-exsisting medical condition therefore Mrs Pickup would not be eligble for full cover anyway.
    In the circustances I regret that I am unable to uphold your complaint that the payment protection was mis-sold I trust the above has been adequately explained the reasons for this decision and thank you for providing us with this opportunity to address your concerns.

    I can only say that if this was the case why did I bother to ring for a claim form in the first place. My husband does not remember speaking in great detail about the policy and neither do I. It appears that we were mis-sold the policy anyway as why would anyone advice insurance for someone with a life threatening illness who woud never be covered anyway. There is no way we would have signed up for a five year policy with interest to be paid for 25 years under these circumstances. Can anyone give us adive please on where we go from here. Sorry it is a long one. Thank you:mad:

    Hi Dialysis/Mrs Pickup. I've read your most recent post. Can I ask how you applied for the loan and PPI? Phone/internet/bank? Were you given any documentation which identifies what the PPI covers you for and just as importantly, does the documentation clearly state the very specific level of cover for both you and your partner (referred to in their response)?

  • Hi Everyone, any ideas on this...I am trying to reclaim PPI from Barclay's Credit Card after sending the first letter requesting it all back, I received a letter, words to the affect 'Sorry, no, it has been on your account since Sept 1998 as the PPI was on the application form and you have signed to say you agree. A copy of this can be provided if required...am I stuffed,??? I didn't/remember this?..is it my fault for not reading the small print? any ideas.folks????...many thanks Lilly :rolleyes:

    Hi there Thanks for your reply. We applied for the loan by phone. We recived documentation with regards to the PPI and loan. The booklet we have does not clearly state that I am (Mrs Pickup) not covered for accident, sickness and unemployment. It starts by sayi Picture have recommended that we purchase this policy. I cannot see anywhere in the policy booklet that says I am not covered for everyting. The payper work we have signed also does not say I am not covered. Hope this helps. Thank you for you info

    Can anyone help me and send me a private message please?

    I contacted HSBC yesterday via internet banking and asked to cancel my PPI which is costing me £70 a month and has been for the last 4 years. They replied with the following:

    Dear Mr Andrew Wailes,

    Thank you for your secure e message in regards to Personal Loan protection cancellation.

    We will need to take you through an application for the principle sum left on your loan without the protection. It could be done either in the Branch or by calling 0800130130 between 0800 hrs and 2200 hrs. My colleague will be able to assist you over the phone.

    Hi. You are entitled to contact Picture asking for an SAR – Subject Access Request. Other members suggest this will cost £10 but you will be able to ask for copies of the taped conversations they eagerly referred to in their response. In any case, the documentation you signed when you agreed the loan should have specified the limitations of the PPI cover. Can I ask how many times you have written to these people already? Taking this case through the Financial Ombudsman Service will take several months, which I appreciate may not be as quick as you’d like. I can point you in the direction of comments made by our mutual friend Tiggrae on 30.12.07 - if you're unsure do as Martin suggests and consult a solicitor or claims management company. If I can be of any further assistance, just drop me a response and I will help as much as I can in the absence of the experts.

    I need a bit of advice. Ive recently started a claim against Ford Credit for a mis-sold PPI policy when I bought my car in 2004. I was told by the salesman I would need to take out PPI (their platinum policy!) in order to get the credit, he said this was because my credit rating was not very good and they needed to be protected.
    Anyway the loan was only for 3 years and it was finished in 2007. I wrote to Ford stating why I was mis-sold and I got the standard letter we are looking into it.
    A few weeks later I had a responce from them saying I was not entitled to a refund because I had signed for it and then recived the policy documents in the post. I sent another letter asking them to reconsider and I got a final responce letter from them saying they were not present at the sale so can not verify what was actually said by their salesman.
    I proceeded to report them to the FOS, anyway a few weeks later I have been told by the FOS they cannot investigate as Ford were not registered when I took out the PPI.
    Where do I stand now and where do I go from here?
    Please help I dont want to give this up?
