I was missold ppi by EPF telling me i had to have it to obtain loan. I have made a claim when i was off ill. Can i still reclaim the ppi as missold?0

Can someone advise please?
Just had a reply to the 2nd letter we sent to Lloyds TSB.
We took the loan out November 1998.
Our reason for complaint was
This is due to the fact that I was not given the correct information when the policy was sold, as your salesperson was very pushy in selling me the policy so that I felt I could not say no.
They are saying the policy covered 'Unemployment and Accident & Sickness cover' and we would have been sent a welcome pack including a Statement of Cover booklet, a policy schedule and a Direct Debit mandate and if the policy did not suit our needs we could cancel.
In light of the evidence outlined above they say they are unable to accept our complaint that we were not properly advised about the policy.
If we wish to cancel the policy we can by visiting our local branch.
They point out the FOS guidelines section 2.3 Time Limits, DISP 2.3.1 (1) (c)
then go on to say if we are unhappy with the decision we can ask the FOS to independently review our complaint!
Do we have to accept LLoyds decision as we are still paying the PPI and our complaint was about the way the policy was sold not the cover (we also didnt know we could have gone elsewhere).
Any help greatly appreciated.0 -
the time limit rules say 6 years from point of sale or 3 years after you became aware of the issue - state you've only just been made aware of the issue through the media interest and therefore you are within the 3 year time limit

if lloyds have made a final reponse then complete the FOS complaint form and under 'further information' put in you've only just been made aware of the fact PPI is not compulsory etc. Then send a copy of the completed form to Lloyds as 'a courtesy'

hi there,
i wrote my letter to lloydstsb and they said they couldnt do it by letter, it had to be over the phone(even though in their leaflet they said it could only be done by letter). anyway, they agreed that i had been mis-sold my ppi but would only cancel my original loan, ask me to take out a new one, and only refund the ppi i paid back into my new loan payments, not into my account. can they do this? it's my money. but they said that my new loan application 'would be in jeopardy' if i refused. in other words, if i didnt do as they said, i'd have to pay the whole loan back. why cant i just keep my original loan and get a refund on the ppi. it's their mistake, not mine.should i accept?0 -

Hi RT,
If you read my posts i have had the exact same response from LTSB and my loan was nov 98!
I have gone to the FOS and LSTB have now raised a jurisdiction issue ( they are suggesting to the FOS they shouldnt deal with my complaint due to 2.3.1 )
LTSB have however told me if the FOS take on my case they will settle.
I am waiting on a decision from the FOS if they will take on my case and i'll keep you posted on how i get on.

can somebody tell me if you have a finanial advicer to get you this protection,and you want to claim for miss.sold who should deal with it as sent ppi letter to insurance company and they said they are not liable but they took 63 every month so i am stuck.0
