Swift Advances - anyone trying to reclaim from these? I wrote to them regarding the high settlement figure I paid them last year for a secured loan I had with them. Ive received a 2nd letter from them who are offering me £130 as ' having reviewed the fees applied to your account in detail, I can see that we have misapplied a number of items and therefore these should be refunded to you'. A cheque is to be issued to me 'shortly'.
I am still pursuing my PPI claim from the above loan but it may be an idea to check thoroughly the final breakdowns they are given and ask for 'baby English' explanations to anything they dont understand.
Im also waiting to hear from Welcome Finance re: my PPI claim from them too. (dont I choose lovely Lenders!!!)!

Took out a loan with Liverpool Victoria in Feb 2003 £10,000 over 6 years. Applied on internet. When paperwork came it included the PPI so I thought it was compulsory. On looking at the details it could be cancelled within 30 days of start date. Have often wanted to cancel it but thought there was no get out. Can I now cancel it? and is there any chance of getting any more refunded? It appears to have been a single premium payment. Any help apprecaiated.0

Thank you am flued up and DW is desperately trying to clean house while i lie dying here only joking a trying to recover as fast as possible. I took Black horse to court and they have offered to pay out to me. You should be getting a letter from SECHIARI, CLARK & MITCHELL there solicitors in settlement of the case. Good luck.Jen0

hi there glad to see you online been sitting here trying to work out what to put on my N1 form with effect to the misrepresentation act 1967
we were told ppi was compulsory to get loans so would this be the right road to go down ..thanks for any advise

Have you read the PPI reclaiming article? It explains a lot of things there.

Hi there Jen, yes its the 1967 Act - it's only 3 pages long and there are only 3 types of Negligence - Fraudulent, Negligent and Innocent - it's the Negligent part you want - you also need to put in about good faith and the fact the defendant induced you as 'a reasonable person' to purchase the policy and they were in the position to know the truth (ie that the policy was not compulsory).

Thanks for that, i have filled in N1 forms today also spoke to my local court because last time when i went through moneyclaim online it cost me £120 i know i got this back from lloyds but the girl at courts told me to fill in an EX160A which as i recieve tax credits (like most people do) i can take them to court for free..so will keep you post and prob craze you in the process for advise but glad of people like you on here this time as there wasn't anyone with inside knowledge about on the reclaiming bank charges forum thanx againJen0 -
Help!!!
Just got my first letter back from WELCOME finance basicaly saying that I signed the forms disclaimer saying i know that ppi is optional! But surly My letter saying that it's the fact they added the "cash price" of ppi to the loan making my £5000 loan a £7500 loan.
Also it said about FOS rule DISP 3.3.1(3)R My case has no grounds of success.
