there was no interview all the paperwork was posted out after a phone call!

Quote this in a letter saying that PPI was not explained as the interview was done over the phone and indication in the letter stating that all forms needed to be signed not indicating that it was optional at all.

I agree although i think you forgot to include people's person circumstances also need to take a role in which line you take. The MCOL proceedure can take upto 3 months where as the FOS can take a lot longer and it the person situation which will deem which route he should shouldn't take. I am in the prime position where have two claims sent at the same time one via MCOL and the other via the FOS. The MCOL is almost settled where as the FOS hasn't even started on the other claim. The case was raised on the 6th of December so that should give a indication.

I would suggest if someone has PPI currently attached to a Loan of Card and wants it corrected then to go the FOS route as it is the only way to ensure that the interest is re calculated and the whole product is correctly dealt with. If the loan is settled then to go the MCOL route for ease.
Halifax's company policy is to deny every claim then pay up IMMEDIATELY on commencement of proceedings - other's will battle it out to the nth degree

If you haven't defaulted on this loan at all don't worry as you still have a contract with them. Any other business is exactly that other business. For example am claiming PPI on two settled loans with Black Horse and also the curret PPI i have on the loan with Black Horse.

When I was doing the bank charges claims never used to bother even writing and asking for the refund - just started proceedings - knew they'd pay up straight away !! ;)

    Hi all,

Just been reading through the latest posts about court proceedures and the misrepresentation act 1967. Just wanted to know can I quote this act if I am basing my claim on the fact that a was sold a single premium policy over only five years when I thought it covered the entire loan. Also, about the interest being charged over the entire loan etc etc etc. I DID know that it wasn't complusary.

Currently finalising third letter to First Plus and threatening court action. Just want to get my facts right before I send if off.

    All help greatly appreciated.

Well I did what was reccomended to me and told HSBC that I would go to the Ombudsman if they did not refund my PPI payments on my Credit card as they did with my loan, but they are not budging, bit confused now as it is the same case as with my loan I was not working enough hours to be able to claim if I had needed to, what id different with the credit card, I am now working enough hours so now I suppose if need be I could claim but for 4 years I was not, any ideas I was expecting them to crumble within a week as was suggested to me.
Claimed back almost £4000 so far from HSBC for mis-sold PPI
£2083.00 + £242.00 8% interest from FirstPlus and lower monthly premiums:D Studio Cards paid off my account and gave me £125.00 in gift vouchers. £500.00 Barclays.
